Xu Zhifeng, a former member of the Legislative Council involved in four criminal cases, was approved by the court to leave Hong Kong while on bail to visit Denmark, but he declared exile after arriving there.

The Department of Justice therefore charged him with 4 counts of criminal contempt of court. In his absence, High Court Judge Chen Qingwei today (29th) convicted Xu Quan, scolded him for having no remorse, and sentenced Xu to three and a half years in prison.

Xu Zhifeng was charged in 4 criminal cases, including his involvement in asking a citizen to delete the video clips and photos of the protesters on his mobile phone on the day of the resumption of the Tuen Mun parade in July 2019, and 3 cases of contempt of the pro-democracy parliament.

In an earlier ruling, the judge pointed out that Xu Zhifeng fabricated false itineraries and invitation letters for foreign visits, and deliberately absent from the hearing was a planned crime.

Xu claims to be in exile on a foreign visit in 2020

The Department of Justice accused Xu of providing false information to the police in order to escape from Hong Kong, and he had plans to do so as early as September 2020.

According to the letter from the law firm representing Xu, Xu claimed to be invited to visit and will return to Hong Kong in early December 2020.

When the police asked Xu for information on the itinerary, the law firm also provided the relevant itinerary.

However, after leaving Hong Kong on November 30 of the same year, Xu posted on Facebook on December 3 that he was "officially declared in exile."

Xu currently lives in Australia.

The Department of Justice earlier pointed out that Xu learned that he was accused of contempt of court, but he has not responded. It has been many months since then, and the court should consider him to give up his right to defend.

The judge also convicted and sentenced Xu in absentia.
