The petitions committee of the state parliament has formulated a "provision" with regard to the illegal buildings in Wolfratshausen.

Now the ball is in the district office.

Wolfratshausen/Bad Tölz - "The district office will fully comply with the recommendation of the petitions committee": This was announced by the press spokeswoman for the district authority in Bad Tölz, Marlis Peischer, on Friday when asked by our newspaper with a view to the three illegal buildings in the Wolfratshausen district of Weidach.

This means that the tenants now have one year to look for a new place to live.

After the lower building control authority had requested the client, as reported several times, to demolish the single-family houses at Isarspitz 24, 24a and 25 by October 1 of this year at the latest, he took legal action.

In the last instance, the Bavarian Administrative Court dismissed the Geretsrieder's claim that he was subsequently granted a building permit for the houses.

At the same time, the client submitted a complaint via the district office to the petitions committee of the state parliament.

Before its meeting last Wednesday, the state government had issued a statement on the Isarspitz cause.

She pointed out to the city of Wolfratshausen that it would be possible to legalize the illegal constructions later by drawing up a development plan.

District office wants to “process the individual points”

The petitions committee finally sided with the tenants: The state politicians formulated a "provision", according to the CSU MP Benjamin Miskowitsch, to the district building authority: The three tenants are given one year to find new living space.

According to Miskowitsch, this should be understood as an “urgent appeal” to the authorities.

That's exactly how it's done now.

According to press spokeswoman Peischer, they are waiting for the minutes of the meeting of the petition committee - "the individual points will then be processed." This also includes the "appeal" to check again whether the houses could not be reduced to a legal level.

The one-year grace period also applies to the client.

A demolition of the houses is most likely "inevitable", according to the tenor of the 14-member petition committee.

If the district building authority issues a formal order, the three illegal buildings must be erased from the Weidacher map by October 1, 2023 at the latest.

The developer can appeal against the demolition order.
