In an unusual way, the Berlin Senate is opposing an early repeat of the elections to the House of Representatives and the district assemblies in the capital.
On Wednesday, the local constitutional court announced that in a preliminary assessment it was tending to declare the elections of September 26, 2021 invalid.
These were so flawed that not all eligible voters had the opportunity to cast a valid vote “under reasonable conditions”.
In a first reaction, the Senate expressed surprise at the court's assessment: "We did not receive an invitation to comment," said a spokeswoman.
Maybe it got lost in the post office.
However, there is almost certainly no knowledge of mass voter complaints, although that still has to be checked.
However, this could take until at least December 2023 because a backlog of complaints from 2011 and 2016 had to be processed beforehand.
In fact, according to the Senate's assessment, the last election went "to the best of our ability" and "on the whole in order".
The evidence for this would be sent to the court immediately as soon as the corresponding files were found again: "They are there, but not there right now."
Of course, the Senate will accept and implement every decision of the Constitutional Court as soon as it reaches it through official channels.
But it is currently being remodeled.
