He was sipping a gin and tonic as he drove his truck through the streets of La Spezia, but was noticed by local police officers who stopped him after following him.
When the door was opened, the officers were hit by a strong smell of alcohol, while a bracket was mounted next to the seat to house the glass.
The man, however, refused to undergo the alcohol test, despite the test with the precursor of the breathalyser had given a positive result.
Informed of the consequences, he replied that "he would have gambled at the trial" and not even the intervention of his trusted lawyer was able to make him desist from his decision.
Further investigations made it possible to ascertain that the man was not new to this behavior and indeed for him drinking while driving was not an exceptional circumstance.
He was thus denounced for the crime of refusing to undergo a test with a breathalyser, a crime that provides for the application of the same penalties that apply to those who drive drunk in the most serious range of the results of the tests with alcohol test.
He therefore risks up to 6,000 euros in fines, arrest for up to one year, suspension of his driving license for 2 years and 10 points deduction from the same.
Furthermore, in conjunction with the suspension of the driving license he will have to undergo a medical examination.
