The Magistrate's Court in Petah Tikva ordered the release from custody of a 36-year-old resident of East Jerusalem, who was arrested on suspicion of committing indecent acts on a young woman at the beach, following a police failure during his investigation.
About two weeks ago, the man was arrested following a young woman's complaint that he exposed his penis to her at Palmahim Beach after she refused to talk to him, and followed her to her apartment.
The suspect was found by the police on the beach when he was drunk and detained for questioning.
According to the police, he even attacked them during the incident.
Following the failures of the police investigation, among other things, the questioning of the suspect while under the influence of alcohol while waiving consultation with a lawyer, collecting additional testimony from the complainant, locating eyewitnesses and locating documents from security cameras, Judge Zohar Divon Segal ordered his release without restrictive conditions.
This, despite the seriousness of the suspicions against him.

In her decision, the judge criticized the police: "In a rather puzzling manner, and although the representative of the investigating unit stated that he was under the influence of alcohol in a way that made it impossible to collect his testimony, the investigating unit believed that this would lead to the waiver of the suspect's right to consult a lawyer, and continued his investigation when He is silent."
"In fact, as of yesterday in the early afternoon, the investigative unit finished its investigation into this case and did not bother to do even one investigative action in order to advance it," added the judge.
"With great right, the suspect's attorney complains about being arrested and left at the police station for an unnecessary night, in disgraceful conditions and without being provided with minimal basic equipment."
The Israel Police stated:
"This is about the arrest of a suspect who committed sexual offenses in public at the beach, when his investigation was conducted professionally, according to the law and in accordance with the provisions of the law while respecting his rights, after he sobered up, in coordination with the defense and contrary to what is alleged in your application.
The suspect was also given the right to consult with a lawyer, and despite his refusal, a lawyer from the public defender's office was summoned to the police station. We will continue to investigate the case with the aim of finding the truth and bringing the suspect to justice."
