Applicant has a legal right

The authorities are of the opinion that the construction project with the two coaches in the area of ​​Bahnhofstraße/Nördliche Viehgasse fits into the surrounding area and is therefore permissible under planning law.

The applicant has a legal right to the building permit being granted.

The Planning Association for the Outer Economic Area of ​​Munich, from which the municipality has obtained an opinion, cannot identify any urban planning reasons from which it can be deduced to refuse consent.

“In our estimation, this is an unplanned interior area.

Thus, there is building law,” it says in the answer.

The planning association shares the municipal administration's assessment that the area on the west side of the track is a mixed-use area.

Residential use is permitted.

Reference to Bahnhofstrasse

In the detailed statement of the planning association, it is also said that immission control could possibly be an issue.

However, this is not likely, since residential buildings next to commercial establishments already exist or are being built in the immediate vicinity.

This refers to the large construction project on Bahnhofstrasse, where 60 apartments have already been built in four apartment buildings and where investor Friebe will build two more complexes, each with twelve units.

The district office gave him the building permit for this – the clear vote in the referendum in May could not change that.

Only Braunegger is for it

With regard to the nearby railway track, the planning association explains that the railway traffic is negligible due to the low intensity of use (only a few trips with freight traffic).

In addition, on the north-eastern outskirts of Denklingen, there are residential buildings just as close to the track of the Landsberg – Schongau railway.

The municipal administration had recommended approval for the construction project.

During the vote, Mayor Andreas Braunegger was the only one who raised his hand when he said "yes".

All councilors were against the municipality giving its consent to the construction project at the "second hearing" of the district office.

Semi-detached houses are okay there, commented Regina Wölfl from the Free Voters' Association Denklingen.

But she didn't want to have two three-in-hand with terraced houses there.

Michaela Killmann (Epfacher Liste) agreed with this opinion.

As reported, the topic was postponed when the building application was first processed in April.

Three reasons were given: There is a Hirschvogel unloading point there, the triangles of sight of the Deutsche Bahn must be observed, and the project is in the "renovation area of ​​the town centre".
