Last February, Deri was sentenced at the Jerusalem Magistrate's Court, following the tax offense case in which he was convicted, to 12 months of suspended imprisonment for three years, and to pay a fine of NIS 180,000.

Deri was convicted of not reporting to the tax authorities the full amount he received from the sale of an apartment in Jerusalem to his brother Shlomo Deri.

Regarding the possibility of defaming Deri if he only returns to the Knesset, the provisions of the Basic Law of the Knesset deny the right to be elected from those who have been sentenced, in a final judgment, to an actual prison sentence for a period exceeding three months, and on the date of submission of the list of candidates, seven years have not yet passed from the day he finished serving the actual prison sentence , unless the chairman of the central election committee has determined that there is no defamation with the offense of which he was convicted.



In Deri's case, he was not charged with defamation and in the sentence he was sentenced to a suspended prison sentence, but nevertheless there are additional provisions in the Basic Law which state that as soon as a member of the Knesset is convicted by a final verdict of a criminal offense, and the court determines on his own initiative or at the request of the Attorney General, that the offense is accompanied by defamation , his membership in the Knesset will cease on the day the judgment becomes final.



On the other hand, the Basic Law of the Government states that a person who has been convicted of a crime and sentenced to prison and on the day of his appointment, seven years have not yet passed from the day he finished serving his prison sentence, will not be appointed as a minister if the court has determined that the crime for which he was convicted is related to defamation.
