The norm, approved after the setback of the Supreme Court, established new requirements to obtain licenses and decreed zones free of weapons such as Times Square, parks or churches.

A federal judge on Thursday halted key provisions of New York's new state rule that attempts to restrict who and where can carry a firearm in public, passed in September after the Supreme Court's blow to the previous law.

Magistrate Glenn Suddaby considered unconstitutional the requirements imposed to grant licenses, such as the obligation that applicants give information about their social networks.

“Simply put, instead of becoming a licensing jurisdiction, New York has further entrenched itself as a non-licensing jurisdiction.

And, in doing so, he further reduced the constitutional right to bear arms in public for self-defense…to a mere request,” the judge wrote in his ruling.

The ruling upholds restrictions prohibiting carrying firearms in schools, government buildings and places of worship, but the justice said the state cannot ban guns in other sensitive places, such as Times Square.

The judge gave the state three business days to appeal the decision.

These measures are part of a law on weapons that took effect in September to protect public safety and comply with the Supreme Court ruling, which invalidated the previous rule to grant permits to carry firearms outside the home.

The new law tightens the training requirements for applicants and requires them to provide more private information, including a list of everyone who lives in your household.

Suddaby said the law's condition that an applicant be of "good moral character" is unconstitutional.

The governor, Democrat Kathy Hochul, and the Democratic-majority state Congress passed the law in the summer, shortly after the Supreme Court struck down a rule that required people to demonstrate an unusual threat to their safety in order to get a license. of firearms outside your home.

The lawsuit that led to the federal judge's ruling was filed by six upstate gun owners who say the law violates their constitutional rights.

Most have gun licenses and argue that the rule prevents them from carrying them in places designated as sensitive, such as parks or churches.
