The European Court of Human Rights (ECHR) rejected this Thursday, September 6 the request of a Rhone firefighter, suspended from his duties after having refused to be vaccinated against Covid-19, on the grounds that he did not has not exhausted the avenues of appeal before the French courts.
Pierrick Thevenon had been suspended from his duties as a firefighter by the Rhône departmental fire and rescue service on September 15, 2021 for not having respected the vaccination obligation imposed on certain professionals, nor having presented a medical certificate from contraindication, requirements set out in the law of August 5, 2021.
He then “
directly
” seized the ECHR, citing violations of the European Convention on Human Rights, in particular the right to respect for private life and the prohibition of discrimination.

Unanimously, the European magistrates ruled the request “
inadmissible
”, “
fault for the applicant to have exhausted the internal means of appeal before seizing it
”, in this case before the administrative courts.
