"Breach of trust? Laziness": The future of the justice system at the Israel Hayom conference Israel today

One of the questions in the survey presented at the beginning of the Israel Hayom conference indicated a very low level of trust among the public (44%) in the judicial system.

Against the background of these findings, and the lively public discourse on the issue in the election system in particular and in recent years in general, a panel of four Knesset candidates convened to discuss the issue, led by Israel Hayom's legal reporter, Netael Bandel.

MK Simcha Rotman (Religious Zionism), MK Efrat Raiten (Labor), MK Gabi Lasky (Maretz) and former deputy head of the National Security Agency Moshe Saada (Likud) participated in the discussion.

The panel opened with a question addressed to MK Raiten: 

you expressed a position against the broadcast of the interviews in the committee for selecting judges of the Supreme Court, and I wanted to know: what did you do there that you want to hide from us?

"Transparency is an important thing," replied the Knesset member from Labor.

"As soon as you put the camera on and you don't have rules, it's not like in a court where the cameras are turned on and you have broadcasts at the High Court.

There you have a panel of judges, and everyone knows the rules of the courtroom.

In this case - they have not determined what will happen and how it will happen and how to do it.

If it comes to this place where an interview is done in a dignified and clear manner, of course I will be in favor."

MK Leski: "Ready to represent the boys of Givat"

A question was then directed to MK Laski: 

as a consistent principled position, you are against collective punishment, and you represent families of terrorists against the demolition of their homes. You have also spoken out on the issue of offsetting terrorists' salaries. Will you, in the next government, if you are a member of it, work to repeal Regulation 119, which allows the demolition of terrorists' homes?

"First of all, I want to make it clear: I unequivocally condemn terrorism, and I am against payment for acts of terrorism and violence," Leski began.

"I have to say, and not for the first time, that I told even the boys from the hills, not exactly the people with whom I have an ideological dialogue, that I am ready to represent them in matters of administrative arrests. I think that a person should be punished for his actions, not a collective punishment."

Will you work to cancel Regulation 119?

"I have more important things to do right now, but I think that people should not be punished, the families of those who did not do it, neither Palestinians nor Jews. Because here there is a distinction. Collective punishment here is usually towards the families of Palestinians, and even Never of Jews. I am against collective punishment of Palestinians and Jews alike."

Moshe Saada, did you sew a bag for Netanyahu?

"The case is being conducted in the district court in Jerusalem," replied Saada.

"As a lawyer, I do not express an opinion on a case without knowing page by page, line by line. There are miscarriages of justice in the Netanyahu case, and they prevented me from investigating. The senior officials told me that they do not investigate information that we had to investigate, and that in a reformed country it would have been investigated. Nobody wants check it out".

MK Rothman, Olmert was accused of breach of trust - and you are calling for the breach of trust to be abolished. Can you explain to me how this corruption can be enforced without committing a crime?

"Nisso Shaham, for example, is an excellent example of a person who was convicted of a breach of trust, something that is scandalous like no other, because there was a likelihood of a breach of trust, which was something innovative," replied the MK from Religious Zionism, who presented his plan about a week ago to abolish the crime of breach of trust.

Are you in favor of canceling the offense, Sada?

"The crime of breach of trust existed in the State of Israel before there was a law on gifts and a law on the obligation to tender, and before the crime of bribery grew so much. Therefore, in the absolute majority of cases, including the Olmert case, I would find you at least four other criminal offenses against which an indictment could be filed. Perhaps this is Mental laziness. In the eyes of the prosecutor's office, the punishment for receiving gifts does not seem severe enough to them, and they file according to something they thought could be filed."
