MK Moshe Arbel of Shas submitted a proposal to amend the basic law: the government, under which Deri could be appointed a minister even though he was convicted and received a suspended sentence. In the future coalition, they plan to pass the proposal in a lightning procedure even before the government is sworn in

Today (Thursday) MK Moshe Arbel of Shas submitted to the Knesset Secretariat a bill that would allow the appointment of party chairman Aryeh Deri to the position of minister. This, despite the fact that he was convicted of tax offenses as part of a plea deal and legal concerns arose against his appointment.

According to the bill, it will be amended Basic law: The government, and it will also be stipulated that establishing such a significant restriction on a person's possibility to be appointed as a minister will be conditioned on the fact that he has been sentenced to an actual prison sentence, and seven years have not yet passed from the day he finished serving the actual prison sentence. This means that in the case where a person was sentenced to condition, there will be no restriction on his appointment as a minister.

The explanatory notes to the bill state that "This amendment is intended to create certainty and clarity, to bring legislative harmony between the eligibility provisions applicable to ministers and those applicable to members of the Knesset and local authority council members, and to optimally guarantee the right to be appointed as a minister, since the appointment of a minister is made through the approval of the Knesset by a majority of its members , and ensuring the correct interpretation of the eligibility clause serves this purpose."

In the future coalition, they plan to pass the bill in a flash procedure in a second and third reading even before the government is sworn in.

This is to prevent the possibility that a petition will be filed with the High Court, and a decision will be made against Deri's appointment - something that will delay his appointment for a significant period of time.
