But things turned out differently.

This is also the case with “Enadco”.

Because the accused (58) made a clean sweep at some point, the first criminal chamber at the Munich II Regional Court was able to make a relatively mild sentence: two years of imprisonment on probation and a fine of 3,600 euros.

Born in Munich, he had been promoting his business idea nationwide from Starnberg and Pöcking since 2013 to offer tailor-made advertising on the Internet.

But the company "Enadco" never went public and investors never saw their money again - or at most a fraction.

This led to charges of commercial fraud in 222 cases.

In the meantime, the ex-entrepreneur is left with nothing and takes care of his sick mother.

Taking evidence down to the last witness would not have been practicable, as Judge Thomas Bott explained in the verdict.

Some of the 222 victims now live abroad and would not be obliged to appear.

Other investors from the past had their apologies: A dentist, who had invested considerable sums in "Enadco" at the time, let it be known that a specialist medical congress is much more important to him than a court hearing in Munich.

"They have checked the matter," explained the defendant's lawyer, Carolin Schaal.

"These were doctors, entrepreneurs and also footballers who had enough money to speculate." In the end, the number of accused cases was reduced to 30, 14 of them with damages of more than 50,000 euros.

Investors quickly wanted maximum returns

The few victims who strayed into the courtroom made an impression - albeit not a good one.

Among them was a biology teacher who suddenly had a lot of money after a divorce.

She wanted more, embarked on the risky business without knowing anything about the subject – and when it didn't materialize, she shrugged it off.

None of them showed what lawyers call "zeal to take responsibility".

Basically, the lawyer only made one accusation against her client: that he had given the wrong impression that he was also bringing money into “Enadco”, the talk was always of around 200,000 euros.

Otherwise, she saw him more as a victim, including the sometimes windy investment advisors.

He did not collect any appreciable income as managing director.

Even the prosecutor showed leniency in his plea.

"I don't see classic investment fraud here," he said.

“Here, no one pretended that this was a safe facility.

Everyone knew about the risk.” Above all, it was important to the public prosecutor that the accused showed credible remorse.

That was the case.

The accused does not even receive Hartz IV

In the end, the verdict was the result of an understanding between the parties.

The regional court ordered the collection of the total amount of damage of 1.2 million euros.

But there will be nothing to get.

Currently, the ex-entrepreneur does not even receive Hartz IV. He failed to apply.
