The Argentine justice ruled Friday, November 25 to challenge as requested by Vice-President Cristina Kirchner the judge investigating the September attack which had targeted her, but suggested that she investigate a right-wing opposition deputy , according to the judgment quoted in the media.

The Buenos Aires federal appeals chamber has confirmed judge Maria Eugenia Capuchetti in charge of the investigation into the September 1 assassination attempt.

She considers that the way in which the investigation is carried out to date "

does not attest to any act of the magistrate from which an objective and precise fact of bias can be deduced

", invoked by Cristina Kirchner's lawyers, according to the judgment. quoted by media including the official Telam agency.

Judge's impartiality questioned

Cristina Kirchner had in recent weeks publicly questioned the impartiality of the judge, denouncing her reluctance to explore possible political links of the perpetrators of the attack.

Three people between the ages of 23 and 35 have so far been charged and imprisoned.

The former Peronist president (center left) from 2007 to 2015 and her camp reject the idea that the trio of suspects are mainly motivated by a hatred of her person or her ideas, which emerges from the analysis of their telephone conversations and messages.

She is convinced on the contrary that there is a political orchestration behind the attack, and that behind her attackers there was private funding linked to the government (center right) of Mauricio Macri, president from 2015 to 2019. She criticizes in particular to the judge for not having summoned a member of the PRO (right) and ex-Minister of Security, Gerardo Milman, whom witnesses would have heard mention the death of Cristina Kirchner in a bar near Parliament, two days before the attack.

In its decision, the appeals chamber asks the investigation to “

corroborate or dismiss

” the facts brought to its attention, namely that one of these witnesses allegedly heard MP Milman “

pronounce the sentence: ''when they kill her, I'll be on my way to the coast''

.

While the motion for recusal presented by Cristina Kirchner was pending, Judge Capuchetti had herself decided this week not to formally relinquish the case, but to "

delegate

" the investigation to a prosecutor already a member of the team.

This, she explained, for the purpose of "

better administration of justice

", given the impact of the request for recusal against her.
