A young man who was caught driving under the influence of a large amount of drugs - on two separate occasions - received a minimum disqualification sentence in court.
The reason: a strange mishap by the police, who lost the central piece of evidence in the case - the electric bicycle on which, as it were, the young man was driving when he was drugged.
"The police mishap greatly shortened the road and made it easier for us to reach a plea deal with her," says attorney Reuven Malach, who represented the young man in the legal process. Case".
Caught with huge amounts of drugs
. The young man (18) lives in the north of the country and is considered a "bull on the run". drug effect.
In the first indictment filed against him, it was stated that in March 2019, he was caught by the police while driving an electric bicycle under the influence of cannabis-type drugs, when the amount of drugs in his urine sample was found to be 2,225 ng/ml.
In the second indictment it was stated that a few days earlier, in February 2019, the young man was caught driving a Yamaha motorcycle, when a urine test conducted on him found cannabis in a concentration greater than 1,000 ng/ml.
"The accused was driving a motorcycle when his behavior was lethargic and his eyes were half asleep," the indictment stated.
Ambush of observers on a confused young man In
order to stop the confused young man, the police used an excessive effort.
"Two cars, three-four policemen and observers were used against him," said Attorney Malach during the hearing of the young man's case in court. "They are looking for this guy instead of investing the resources in another place where there are murdered people."
During the hearing, a puzzling police malfunction was revealed: the police representative said that he was unable to present to the court the electric bicycle on which the young man rode when he was allegedly drugged. "The bicycle has been returned," claimed the police representative, but was unable to present any document that proves his claim.
Attorney Malach hastened to respond to this matter and emphasized that "throughout All the way the young man claimed that he was driving a bicycle with pedals without a battery. Bicycles with pedals do not need a license."
That is, as attorney Malach clarified, without its central evidence, the police is in real trouble.
Following this failure of the police, a plea deal was finally reached with the young man, in which he escaped with a much lighter sentence than he expected and received only 11 months of disqualification for the two cases (in addition to suspended prison sentences and a 14-month conditional disqualification).
If that wasn't enough, the police suspended the young man's disqualification sentence, so that he could drive and drive his son with special needs to kindergarten and his father to medical treatments at the hospital.
