The British Supreme Court denies the right to self-determination and even a consultation without legal effects


The Scottish mirror suddenly returns thanks to a ruling by the United Kingdom Supreme Court that denies the Parliament of Edinburgh the right to call a referendum on self-determination.

The resolution doctrinally exceeds the scope of the United Kingdom, since it rejects the right to self-determination of peoples, except in the case of colonized or occupied countries, and bases it not only on the British Constitution, but also on high court rulings of Canada and the United Nations.

It also determines that it is the Parliament of the State, and never a Parliament of a part of the territory without constitutional powers, which has the capacity reserved for such type of decision.

British judges reject a unilateral consultation even when it does not have direct legal effects, as argued by the Scottish Government, since it affects relations between Scotland and the United Kingdom, under the exclusive jurisdiction of London.

Nicola Sturgeon, who has accepted the sentence and rejects Catalan unilateralism, refers as an alternative to the next elections, which she wants to be held in plebiscite.

He knows that not even with an overwhelming pro-independence majority could they give rise to a unilateral declaration of independence, but to the normal negotiation between Edinburgh and London on the margins of self-government.

That it is the only practicable path, both for Scottish and Catalan nationalism, within the western liberal and democratic space.
