The Colmar Assize Court on Wednesday (November 30) sentenced a 65-year-old man to seven years in prison for having neglected his mother, who died at 86 in a state of advanced physical dilapidation, and to 3 years in prison suspended the doctor of the latter, for failure to assist a person in danger.

At the end of three days of debates, the daughter of the victim, aged 61, placed under reinforced curatorship and prosecuted for non-denunciation of ill-treatment and failure to assist a person in danger, was released.

In May 2017, according to the story of the newspaper

L'Alsace

, paramedics were called to move the octogenarian from one floor to another, in a building in a "

very disadvantaged

" district of Mulhouse.

On the spot, they discover a woman covered with bedsores and wounds, showing signs of malnutrition and dehydration.

They decide to transport her to the emergency room, where she dies a few hours later.

Shocked

" by the state of the patient's body, the hospital team then decided to report it to the public prosecutor.

The investigation established that the victim, who lived with her son, had not left her bed or been showered since 2015. According to several witnesses, the son, who received the RSA, with no other social or emotional ties than that shared with his mother, was "

overwhelmed

" by the situation.

Not daring to wash her anymore, he contented himself with cleaning her upper body.

He was prosecuted for "

neglect of a person unable to protect himself, followed by death

".

The attending physician had come to see the victim two days before his death, for his monthly visit.

He explained to the court that he had not received any "

complaint

" from his patient, but admitted

to having "missed

" his state of health and admitted to a "

series of failures

".

For his shortcomings, the doctor had already been reprimanded by the council of the order.

He retired in April 2021. The psychological expertise insisted on the “

relational poverty

” and the “

great emotional poverty

” in which the family lived.
