Shaftel resigned from representing a senior criminal: "I am not his hostage" - Voila! news

A rather strange hearing was held on Sunday in the District Court in Tel Aviv, which dealt with the request of a known criminal to disqualify the court, during which one of his defense attorneys - attorney Yoram Sheftel - asked to resign from his representation. The hearing, the minutes of which were revealed at the request of Walla!, was held at the request of Golan's defense team Avitan, who was arrested in Morocco and extradited to Israel two months ago as part of the 512 case. The defense sought to disqualify the panel of judges in the case, and the hearing was held in the courtroom of judges Gilia Ravid, Yaron Levy and Shay Yaniv.



"I am not a hostage of the defendant who chose four years ago to take himself and walk out. This is his right" began a lawyer who canceled the discussion in a storm.

Sheftel explained to the shocked judges why he does not want to represent Avitan anymore: "I am now busy with the verdict in Yitzhak Abergil's case. I don't have a minute."



Avitan was a member of Yitzhak Abergil's criminal organization.

He was even one of the organizers of the attempts to assassinate the criminal Zev Rosenstein which caused the death of three civilians and dozens of injuries in 2003.

He fled the country to Morocco in 2018, and two months ago he was deported from the country.



The indictment against Avitan, a 54-year-old resident of Ashdod, was filed as part of case 512, according to which he provided the remote controls that activated the explosive devices remotely in the two attempts to assassinate Rosenstein.

The prosecution team in the case, headed by attorney Nissim Marom, returned to the courtroom to conduct the prosecution against the last of the defendants in the case, after the proceedings in Avitan's case were frozen due to his escape.

During the hearing on Sunday, Shaftel added and explained why he wanted to be released from Avitan's representation: "I also made it clear to the accused (Avitan, B.A.) after there was an affair with the indictment filed against him in connection with the threat to the father of the court, that if he again violates the terms The arrest, so let him find another lawyer.

It never occurred to me that he would run away for four years.

Even the defendant I am representing now (Abergil, BA) does not want me to represent him because of the conflict of interests that exist. Therefore, I will under no circumstances represent Avitan. I am not his hostage."



In response to the words, Avitan said: "I have no problem with Attorney Shaftel leaving and Attorney Yaniv Segev staying. Everything he claims to claim is his right, I have no problem with Attorney Segev continuing the case."



Attorney Segev, who found himself between a rock and a hard place, tried to find a compromise and said in the courtroom discussion: "I need to solve this matter, and I think the solution should come by agreement, and not by decision.

This is my opinion.

Of course, the court will decide whatever it decides, but the solution will be correct if it comes by agreement from our side and not from the court."

The stunned judges wrote in their decision: "The hearing was scheduled today for the oral completion of the written arguments put forward on behalf of Golan Avitan for the request to disqualify this Motev from continuing to discuss the case. On the morning of the hearing, we were unexpectedly presented with the words of Attorney Shaftel according to which he is requesting to resign from representation.

Before we decided on this request, Attorney Segev asked for a stay to try and settle things, so we held a break of half an hour. Now the parties have reached an understanding according to which a stay will be granted to submit a brief completion of arguments until the end of the day, thus the parties' arguments will be summed up in the issue and we will make our decision based on the written material." .



In the bottom line, Adv. Segev will submit the request, but it is not clear what will happen next. Adv. Shaftel told Wala!
