Every year again: In its most recent meeting, the Miesbach City Council renewed its ban on fireworks on New Year's Eve.

The decision was passed unanimously without any discussion on the subject.

The general decree on the "ban on burning pyrotechnic objects" is justified with fire protection in the area of ​​the market square and town square.

As is well known, the Lower and Upper Markets are subject to ensemble protection, which allows for particularly strict regulations.

As in previous years, the basis is the fire inspection of August 2019. This brought the result that the city may issue a firecracker ban for precisely defined zones on the basis of the fire inspector's recommendation.

The zones on the market square and town square will be expanded with a 100 meter radius, as will the generally protected areas around churches and retirement homes.

According to the administration, the 100-meter radius is the basis for the definition of immediate proximity, which the Petitions Committee of the Bundestag has set.

However, the city does not have the legal basis for an extension of the prohibited zones, as they are discussed again and again.
