Dina (pseudonym), 70 years old and with no criminal record, was charged with assault after her ex-son-in-law complained that she spat on him because he was late bringing her granddaughter home.

She, for her part, claimed that it was he who threatened her and her daughter, the girl's mother - and the police did not question him at all, not even with a warning.

Now, following Israel Hayom's appeal, the police have offered Dina's attorney to return to the conditional settlement procedure, and if she confesses, the charge will be dropped and the case will be closed.

According to attorney Idan Gamleli, who represents Dina on behalf of the public defender's office, it all started with a loud phone conversation about a year ago between the complainant and his ex-wife due to his delay in returning the girl.

When Dina and her daughter heard his shouts from the house when he arrived, they went down to him in the street, and from then on the differences of opinion.

In their investigation, the two said that they felt "real fear after he clung to us and threatened us, with his words and behavior, and we were sure he intended to attack us."

However, according to the police, the divorced man complained that his ex-mother-in-law spat in his face in the middle of an argument between them, and therefore the indictment was filed against Dina, according to which "in her actions, the accused attacked the complainant unlawfully".

Following this, Attorney Gamleli recently appealed to the police to close the case because the divorced man was not investigated for the alleged threats.

"From all the evidence a clear picture emerges that is not in dispute, that at the very least the complainant committed a serious offense of threatening the two," he clarified, "and although the police received reports of his violent behavior, he was not even questioned with a warning and only gave an open statement regarding the alleged 'assault' he experienced ".

In his letter to the police, Attorney Gamleli claimed that "the verbal violence of the complainant during the encounter was so severe and intense that police reports were received about his behavior in order to protect the two.

The lawyer, based on the evidence in the case, explained the contrast between the two sides' versions by saying that "the complainant left the scene when he learned that the police had been called, and after some time he arrived at the station on his own initiative to give testimony regarding the incident that took place."

At the end of his letter, Attorney Gamleli added that his wife is a diabetic and immigrated to Israel about 15 years ago, and she does not speak Hebrew. "All she asked for in this unfortunate incident," he wrote, "is to go down with her daughter so that her presence will prevent the complainant from harming her again In her daughter - but unfortunately, she found herself with an indictment against her.

"This is an elderly woman, who came to our country out of love and faith that here, in the Jewish state, she will be safe. We, as a society, should not spit in her face. The continuation of the criminal proceedings in her case will be a certificate of poverty for Israeli society."

The Israel Police stated: "The indictment was submitted taking into account the evidence, and after a proposal to close the case in a conditional settlement outside the court's walls was unsuccessful."
