An upside-down world:
The State of Israel will compensate a man who spent five days in detention for a false rape plot with 5,000 shekels - but the case against the young woman who handled it on him was closed due to lack of public interest.
About two years ago, the young woman came to the police and said that Danny (pseudonym) grabbed the back of her neck while she was walking down the street, dragged her to his apartment, where he stripped and forcibly raped her.
Danny, for his part, admitted that he met her but emphasized to the investigators that there was no contact between them, and that she followed him to his house of her own accord, and when she asked to go out, he immediately agreed.
"She asked to relieve herself," he said, "I showed her the bathroom, but she refused. In the end I realized that something was wrong with her and I kicked her out of the house."
According to his attorney, attorney Avi Cohen, even though no signs of violence were found on the complainant's body, and even though his client "cried and begged for the security videos to be released", only five days later, after the young woman admitted that she had fabricated the incident, Danny was released from custody.
Cried his innocence
Last week, a judge at the Peace Court in Petach Tikva, Shimon Stein, discussed Danny's demand for compensation for the days he spent in detention for no wrongdoing.

His defense attorney Cohen noted that "in the vast majority of cases, we start from the assumption that the complainant is telling the truth.
Sometimes there is a question of consent, sometimes the case is subject to interpretation, but finally the prosecutor's office closes the case due to lack of evidence.
In the case in question, unfortunately, it was unequivocally proven that the complainant lied about a blood plot against a guy who did not commit a crime, who lives in poverty and tries to take care of his rights."
The state, through the attorney's office, refused to compensate Danny and claimed that "these are offenses that establish grounds for arrest due to danger", and that "after the complainant said she lied, the police requested the immediate release of the suspect".

Judge Stein, who accepted Attorney Cohen's arguments, ordered the police to compensate Danny with NIS 5,000.
"The suspect fell victim to a malicious false complaint," noted the judge, "and sat in false arrest for five consecutive days while crying out his innocence. Although the damage caused to him was entirely from the side of the complainant, I believe that there is room for compensation."
