The two denied the crime of theft, and the case started today (6th) in the Kowloon City Court.

The plainclothes security guard of the supermarket stated that he saw many goods on the trolleys of the two defendants, including expensive food, but when they used the self-service payment machine, some of the goods were put into the bag without being scanned by the barcode reader.

The defense interrogated the security guard and said that after the police officer arrived at the scene that day, he told the two defendants: In short, if there is no "du" machine, it is considered a theft. The security guard said that he had no memory of the police officer saying this.


Involved in the theft of 10 items worth 1632 yuan

The two defendants: Zhao Mingyu (47 years old) and Zhuang Huimin (48 years old), both reported to be doctors.

They were accused of stealing a watermelon, a honeydew melon, two packs of pudding, two packs of Blueberries, two packs of sashimi, one pack of sushi and one pack of chicken, the total value is 1632.8 yuan.

Both defendants are registered medical practitioners.

Dispute if you forgot to scan the item

The two were represented by Senior Counsel Luo Yinggan and Barrister Peter Pooh respectively.

Both the prosecution and the defense admitted the fact that the two defendants purchased a total of 23 items at the above address that day, but did not include the unpaid items involved in the case.

The eldest daughter of the two called her parents 6 times that night to no avail, and finally reported to the police that her parents had lost contact, and was later informed by the police that her parents were processing documents at the police station.

The prosecution revealed that the two defendants will dispute the admissibility of the videotaped meeting and will testify in court.

The defense confirmed that it did not dispute that some of the items had not been scanned, but disputed the intent of this move, that the two men either forgot to scan the items.

Buy expensive items to attract the attention of security guards

The prosecution summoned AEON's plainclothes security guard Chen Xingju. He pointed out that there were 34 self-service payment machines in the Whampoa store involved in the case. After the customer scanned the barcode of the product, the self-service payment machine would make a "dong" sound, the screen would flash once, and the name of the product would be displayed.

Chen Xu said that at 3:40 pm that day, he was patrolling the self-service payment area and saw the two defendants pushing trolleys to the No. 17 payment machine to pay.

Chen saw that the trolleys of the two had a lot of goods, including expensive ones, so he began to observe them. He explained that if customers use the self-service payment machine to buy a large amount of goods, "something will happen easily", so he then Will pay attention to the two defendants.

When the two defendants were intercepted, they both claimed to have given money

According to Chen's observation, when the two paid, some of the goods were put into bags without "passing through the machine (scanned by a barcode reader)", including: a box of sea urchins, a watermelon and a honeydew melon.

Chen suspected that the two were stealing, so after Zhao paid, he followed them to the parking lot on the B2 floor, identified himself to them, and asked, "Did the goods you carry have not been paid?" The two replied: " There is money."

Afterwards, Chen took the two of them back to the AEON security room, and compared the goods in their hands with the receipts provided by Zhao, and found that there were 10 goods that had not been paid for.

He printed out these unpaid items and handed them over to the two for confirmation, and then explained the incident to the store manager and called the police.

CCTV clips were played in the court. It can be seen that the two moved the goods on the trolley to the payment machine counter one by one. Zhao put the goods on the barcode reader to scan, and Zhuang put the goods in the bag, but some of the goods were not scanned. .

The two defendants left the supermarket to continue shopping

During the cross-examination, the defense pointed out that after the two paid the payment that day, Zhao once went back to the supermarket alone to buy salmon roe, and then went to the G floor to deal with the parking discount. B2 floor parking lot.

Chen admitted that the two had stayed for a period of time after paying, including going to the exhibition hall, and he had been following one of them, but he could not remember whether it was Zhao or Zhuang.

The two defendants were intercepted and showed no panic

Chen agrees that after revealing their identities to the two in the parking lot, they did not run away or panic, but cooperated with him to the security room.

When asked if he asked the two defendants to bring all the goods in the car to the security room for inspection, including the goods they bought elsewhere, Chen said he had no impression.

The goods are not directly put into the bag

The defense also pointed out that CCTV footage showed that when the two defendants used the self-service payment machine, none of the goods were put into the bag directly, and all of them were put on the table first and then put into the bag.

Chen agrees.

The defense questioned that when Chen was counting the goods in the security room, he might have accidentally mistook the paid goods for unpaid goods. Chen did not think that this happened, and explained that the police officers would also count the goods in person after they arrived at the scene. When he arrived, he was not present, so he did not see the police count.

The defense alleges that the police once said that nothing to do is stealing

As for the defense claiming that after the police officers arrived, Zhuang once asked: "What is the difference between intentional and non-intentional?" The police officer responded: "There is no difference between intentional and unintentional. In short, anything that is not on the phone is stolen." Yes. Chen once again expressed that he has no impression.

The trial will continue tomorrow (7th), and the police officers who announced the arrest and recorded the statement are expected to be summoned.
