Decent vacations in Mexico: how is the final law and how many days will they have

The reform to extend vacations in Mexico has generated confusion but finally the legislators have agreed on how many days they will be.

The reform to extend vacations in Mexico (known as dignified vacations) has generated confusion regarding the number of days to which workers will be entitled once it is voted for approval in the Chamber of Deputies and between in force by 2023.

Finally this Thursday the legislators agreed and assured that the 12 days of continuous vacations will be maintained, after the minute endorsed by the Senate had been modified in the Labor Commission of the Chamber of Deputies where it was stated that six of the 12 days would have to be taken in a row and the rest would be negotiated between the worker and the company.

How is the final vacation law and how many days will the workers have?

Once the dignified vacation law is approved in Congress, workers in Mexico will have the right to

12 continuous days of paid vacations

after completing the year of work, according to the agreement reached by the senators and deputies of the Morena and Citizen Movement that is based on the original minute endorsed unanimously in the Senate at the beginning of November.

"Of the total period that corresponds to him in accordance with the provisions of article 76 of this Law, the worker will enjoy 12 days of continuous vacation, at least.

Said period, under the authority of the worker, may be distributed in the manner and time that he so desires”, states the minutes cited by the legislators.

When announcing the agreement, Senator Napoleón Gómez Urrutia from Morena explained that vacations will increase two days after each completed year until reaching a maximum of 20 days, which, according to him, meets the minimum established by the World Labor Organization.

  • 3 years: 16 days

  • 4 years: 18 days

  • 5 years: 20 days

  • 6 to 10 years: 22 days

  • 16 to 20 years: 26 days

  • 21 to 25 years: 28 days

  • 26 to 30 years: 30 days

  • 31 to 35 years: 32 days

A sector of the private initiative has shown reluctance to extend the vacation period because it considers that the cost for companies would increase, especially for small and medium-sized businesses, for which reason it requested that the reform be implemented in a phased manner: that they be granted nine days of vacation in 2023, and 12 days from 2024.

The Employers' Confederation of the Mexican Republic (Coparmex) said in a statement on November 17 that they were in favor of the vacation reform but that legislators should be careful that this change is applied gradually.

Gómez Urrutia recognized the resistance from the business sector, but said that the reform brings labor justice, so they resisted the pressures.

When does the holiday law come into effect?

The Chamber of Deputies is expected to discuss the reform so that its implementation takes place as of January 1, 2023 or the day after its publication in 2023.

This reform is one of the ones that has generated the most expectations this year, since in Mexico the number of vacation days has not changed since 1970 and currently workers only enjoy six days under the Federal Labor Law.

Mexico is the country of the Organization for Economic Cooperation and Development (OECD) where more hours are worked per year (2,124), when the average among the nations that make up the organization is 1,687.
