The Miesbach District Office suspects the number of clandestine buildings in the "higher double-digit range" - and that per year.

The district master builder calls for reinforcements for the construction control.

District of Miesbach

- You always cause trouble in the district because builders don't stick to their building application, if they even submitted it.

District master builder Christian Boiger now wants to put a stop to this proliferation of illegal buildings.

"I no longer want to open the door to wild growth," he complains in an interview with the local newspaper.

Since May 2021, when he was appointed district master builder, he has been dealing with a number of illegal buildings.

The most recent examples are on Wiesseer community grounds.

There is not only the luxury chalet in the mountain forest on the way to the Holzeralm.

Once a simple hunting lodge, after massive earthmoving, a sewage treatment plant and a liquid gas plant, it mutated into the holiday home of a well-heeled builder.

When everything was finished, the building was first discovered and put on record.

The district office ordered the demolition.

The owner is defending himself against this before the Bavarian Administrative Court.

A number of municipalities have problems with illegal buildings

In another case, too, when the client went beyond his application and probably interpreted it in an autocratic manner, the district office only objected after the facility had been put into operation.

We are talking about Franz Haslberger and his Saurüsselalm in the landscape protection area of Bad Wiessee.

The construction entrepreneur allowed the patio to be much larger, the awning to rest on metal posts, and a so-called goat shed more akin to a holiday home.

These illegal constructions around the Saurüsselalm continue to occupy the community, for example the building committee tonight, and the authorities with Boiger as the district master builder.

However, since the "revision is still an ongoing process", the district master builder "does not want to anticipate".

Environmental groups and the Tegernseer Tal Protection Association (SGT) had sued.

Only a few days ago they "checked again up there," says Boiger.

The list of illegal buildings in the district is long.

Many municipalities have their problems with it.

Whether, again in Bad Wiessee, an owner on Münchner Straße managed to redesign his property in such a way that the catering business became a car dealership, whether in Tegernsee a house with a lake view received unauthorized extensions, in Rottach-Egern the illegal construction of a wooden hut in the outside area Tempers heated up when a lawyer in Gmund wanted to convert his bungalow for asylum seekers without permission.

One of the best-known black constructions was probably that of the former district administrator Jakob Kreidl.

As once the chief guardian of the district, he should have known that the height of his family home did not correspond to the submitted plans and that there would be consequences.

The district office ordered a construction freeze.

District master builder calls for another building inspector

In Bayrischzell it was a parking deck that was too large and protruded onto community ground without a permit.

There were several buildings on one property in Schliersee on the property of a former municipal council.

Overall, the number of illegal constructions "according to the building authority is estimated to be in the higher double-digit range per year," explains Sophie Stadler, spokeswoman for the district office.

Boiger reports: "In order to prevent such illegal buildings in the future, I have requested reinforcements from a building inspector for my department in this year's budget.

The mayors of the valley also know this and have supported it.” The statements of the heads of town hall contacted by our newspaper are unequivocal: Johannes Hagn (Tegernsee) considers the post of building inspector to be “justified and necessary”.

A building inspector in the building supervisory authority is "quite sensible and relieves all employees of the municipalities," answers Christian Köck (Rottach-Egern).

Alfons Besel (Gmund) refers to the "lower building control authority, which is also responsible for building control".

Robert Kühn (Bad Wiessee), on the other hand, remained clouded until the editorial deadline, although the most headline-grabbing clandestine buildings took place in his community.

Boiger now wants to "intensify" their control, which has so far only been carried out "on a random basis".

In this way, one could “bolsterly put a stop to the illegal constructions”.
