Retired Superintendent Uri Bar Lev testified on behalf of the defense at the last evidentiary hearing in the case of Orian Ben Khalifa, who is accused of attacking a resident of East Jerusalem at the Lions' Gate during an operational activity. Later in the hearing, the representatives of the Criminal Investigation Department presented similarities between sections of the opinion submitted by Bar Lev and the opinion submitted by another witness on behalf of the defense - Amir Halmer, an expert in body language. Bar Lev replied that the opinion supporting Ben Kalifa was prepared in the office of the defendant's defense attorney, "D. Eyal Besargalik, this after studying the investigation materials and clarifying that he does not know Helmer and did not meet him.

"If I were the district commander, I would be Bar and tell her (Levan Kalifa. S.H.) she behaved very well, she did not exercise the power she has the authority to exercise at all," said Bar Lev.



Bar Lev clarified that the reason he came to testify in favor of Ben Khalifa is not due to revenge, in the background of an investigation that was conducted against him in the Police Department during his tenure in the police and was later closed. At this point, the MHS representative asked why the appeal was made specifically to him and not to retired commissioners or deputy commissioners. "Most people are very busy, and I didn't have too much time either," he replied. "But when I read the materials, I realized that I would be lying to myself if I won't come here and tell you - police officer, you've gone crazy. I don't understand how you stay in your job. What's your motive? And why do you close the case for someone who attacks a police officer? A police officer is nobody's trash, shame on you."



Throughout his testimony, Bar Lev claimed that his expertise regarding the case against Ben Khalifa stems from his extensive experience from the various positions he held in the ranks of the Israel Police.

According to him, it is better than the testimony of the fighter who witnessed the attack and testified that Ben Kalifa is lying and the complainant did not attack her.

Bar Lev also said in his testimony that he would not have acted differently from Ben Kalifa and that he would have acted like her.

"There is use of force within the relevant limits. The accused acted as someone who used reasonable force," he said.

Attorney Eyal Basraglik, who represents Orian Ben Khalifa together with Daniel Herman from his office stated:

"Today three more witnesses testified on behalf of the defense.

The first witness was another witness who was at the scene who testified that Mokhtar and his family members acted violently towards the policemen who arrived at the incident.

The second witness is Superintendent Bar Lev, who testified that this was a negligent and biased investigation, that there was no operational flaw in Orian's actions, and that she used proportionate and reasonable force and even reduced force in relation to the incident in which she was attacked more than three times."



"The court asked Superintendent Bar Lev how he believes that such a case should be decided not from the neon but from the area and Superintendent Bar Lev asked that the court simply examine the evidence.

He also criticized the scandalous decision to close the case against Hala and Mokhtar's son, when it is clear from the videos that they attacked Orian.

An MZF expert also testified that the videos were fake. As for the claim by the MHS representative that there was any similarity between Bar Lev's opinion and that of Dr. Amir Helmer - it was enough to hear Bar Lev's supervisor ask who it was about to understand that he did not know that such a witness existed. We are still awaiting the results of our appeal to the state attorney and the ombudsman to stop the trial and investigate the smuggling of the phone by police officer Anan and the falsification of the videos."
