The building committee of the Wolfratshausen city council came to a unanimous verdict: a two-metre-high plastic fence must go again.

Wolfratshausen – It was not the first time that the city council's building committee had to deal with the issue of enclosure recently.

When examining an apartment building on Schiesstättstrasse, the building inspector found deficiencies.

Among other things, the fencing of the property deviates from the building permit.

The building committee unanimously rejected the subsequent permission of the forbidden.

A thorn in the side of Wolfratshausen city councillors: “A plastic fence is not noise protection”

The construction project was approved in January 2019, and in February last year it was examined by the building inspector.

It turned out that a basement exit extends 1.20 meters over the construction line, and the balconies in the north-west also protrude over the construction line.

"In order to restore orderly legal building conditions" (this sentence made the head of the town hall, Klaus Heilinglechner/citizens' association, frown), the client subsequently asked for an exemption from the stipulations regarding the basement exit and balconies.

The members of the expert committee had no problem with that – but they did have a problem with the enclosure.

Builder leads high noise pollution as an argument in the field

According to city councilor Josef Praller (citizens' association), the development plan for the property at Schiesstättstraße 82 stipulates a wooden fence with a maximum height of one meter, while the client erected a two-meter-high plastic fence.

He did this because of "heavy traffic on Schiesstättstrasse", according to an explanation of the facts.

Thanks to the two-meter-high "privacy and noise protection fence" "staying in front of the house is still bearable".

In the draft resolution for the committee, Tatjana Karl from the town hall's planning and environment department noted that noise protection fences have a different quality than the current fence.

Hans Schmidt: "A plastic fence is not noise protection", the client's argument was "only a pretense".

Schmidt pleaded once again for the adoption of an enclosure statute.

This is the only way to put a stop to "further wild growth".

Mayor Heilinglechner: "Local law applies here"

"A two meter high plastic fence is out of the question for me," explained Praller.

Richard Kugler (WOR list) pointed out the high level of noise pollution on Schiesstättstrasse: "Everyone knows where they are moving to." Renate Tilke explained on behalf of the CSU that the parliamentary group would not comply with the exemption desired by the client.

Mayor Heilinglechner stated that the Bavarian building code permits walls and enclosures up to a height of two meters.

But in this specific case, "local law applies here", i.e. the city's development plan.

The vote of the building committee was unanimous, the plastic fence must go again.
