Chen Fen, a senior executive of the Hong Kong company of China Evergrande Group, was accused of attempting to rape a woman whom he had known not long ago. The prosecution said last month that the victim was seriously disturbed emotionally and was unable to testify against the defendant in court. Finally, he decided not to provide evidence for prosecution. It is revoked.

Chen Fen then asked to recover part of the legal costs. Judge Zhang Huiling of the High Court issued a judgment today (14th) to reject Chen's application for legal costs, and disclosed the prosecution plan. After sending the drunk victim home that day, Chen stayed for more than half Hours later, he left in disheveled clothes. That night, he even sent a text message to the victim saying, "Hold your cum tonight, please take care." Afterwards, the forensic doctor found fibers from Chen's clothes on the victim's bust.

Looking at the prosecution's evidence, the judge believes that there is independent evidence in the case to support the prosecution, and Chen is suspected of self-incrimination.

The defendant, Chen Fen (37 years old, a Chinese businessman), was originally charged with one count of attempted rape, alleging that he attempted to rape woman X on the night of March 2, 2021, and the case was dismissed on November 4, 2022.

Chen Fen was originally charged with attempted rape, but the victim was unable to testify because of his mental state. The prosecution finally decided to drop the case.

There are reports that X is unwilling to testify and the prosecution is still insisting on prosecution

Judge Zhang Huiling revealed in her judgment that the defense requested to recover the costs of preliminary investigation, adjournment of trial, and pre-trial.

The defense believes that the prosecution mainly relied on X's evidence and there is no other sufficient evidence to accuse Chen.

The three psychiatric reports successively stated that the interrogation would cause serious harm to X, and X was unwilling and unable to testify, but the prosecution continued to prosecute, and Chen has always denied the charge after his arrest.

CCTV saw that Chen was disheveled when he left

When the prosecution objected to the defense's application, it disclosed part of the evidence of the case, including that, according to X, Chen attempted to rape her while X was drunk.

The prosecution did not have independent evidence to support X's statement. For example, CCTV footage showed that X was seriously drunk at the time, and Chen sent her home and stayed for more than 30 minutes.

Chen Yuanyuan's shirt hem was inside the trousers, and the shirt was buttoned up, but when he left, the shirt hem was pulled out and part of the buttons were unbuttoned.

Chen Tongwan sent a message to Queen X: "Sorry for today, please take care."

The subject bust has Chen suit fiber

In addition, after Chen was arrested, he said: "We went to dinner in the evening, and he was very drunk. I sent him back home, but we didn't have sex." Forensic examination of X's bust found that Chen was wearing a suit The fibers of the jacket or trousers, and traces of X's saliva and DNA were found on the sleeves of Chen's suit.

The case was initially interrogated in the Eastern District Court. The picture shows the defendant Chen Fen. The victim X also appeared in court to testify.

The defense rebutted that X had vomited and Chen was assisted

The defense countered that the CCTV footage showed that X was not as drunk as the prosecution claimed. If X was really drunk, he would not have been able to struggle with Chen.

The defense also pointed out that Chen sent X home, so it is not surprising to find Chen's jacket fibers on X's clothes, and the fibers may be transferred by contact between items.

In addition, X had vomited and Chen had provided assistance, which may have left traces of X's saliva on the sleeves of Chen's jacket.

X has testified at the preliminary inquest

However, the judge pointed out that the prosecution was aware of X's emotional problems before the preliminary interrogation, but X did testify during the preliminary interrogation.

The judge believes that the prosecution has reason to believe that X may be able to testify in court after treatment.

In the end, X was unsuitable to testify due to his mental condition, and the prosecution had no choice but to refuse to provide evidence for prosecution.

The judge agreed with the prosecution's statement that Chen had introduced himself as a suspect.

Apart from X's testimony, there were other independent evidences to support her allegation, and the defense's application for costs was therefore denied.
