Even if the contractor has not been convicted of a serious labor safety incident on the site, the Buildings Department will consider forwarding the application for renewal of registration to the Contractors Registration Committee for interview and review.

The Buildings Department can refer poorly performing contractors to the Disciplinary Committee to decide to remove them after an inquiry

In addition, if a registered contractor is convicted of an offense related to building works, or has committed negligence or misconduct in building works, the Buildings Department may refer the matter to the Contractors Disciplinary Committee in accordance with Section 13 of the Buildings Ordinance.

If the Disciplinary Committee is satisfied after an inquiry that the registered contractor has been convicted or has committed negligence or misconduct, etc., it may order that the registered contractor be removed from the Register of Registered Contractors permanently or within a reasonable period of time and impose a maximum fine $250,000, or an order to reprimand the registered contractor.

The Buildings Department and the Labor Department have established a referral mechanism. The Labor Department will refer serious labor safety incidents at construction sites to the Buildings Department for consideration of taking disciplinary action against the registered contractors involved.

The spokesman added that enhancing construction site safety requires the joint participation of every stakeholder in the industry.

Apart from strengthening regulation, the Government will continue to adopt a multi-pronged strategy, including promoting a construction site safety culture and encouraging the industry to actively adopt innovative technologies to enhance safety performance.
