Justice annuls the conviction for rape of a minor of Farid El Haïry, found guilty in 2003

The Court of Revision canceled Thursday, December 15 the conviction almost twenty years ago of Farid El Haïry for rape of a minor, after the victim confessed to having lied.

said Farid El Haïry, at the end of the hearing on December 7.

"It's impossible !

I've never had sex!"

In 1998, Julie D., a 15-year-old high school student, announced to her family that she had been the victim of rape, her parents filed a complaint and an investigation was opened for sexual assault and gang rape.

During his police custody, Farid, 17 years old at the time of the events, constantly proclaimed his innocence declaring that: “

It is impossible!

I've never had sex!

“During the investigation, the various psychological and gynecological expertise support the accusations of the victim, capable of evoking the facts in a certain way.

Farid E. was finally found guilty of the charges against him and sentenced in 2003 by the Assize Court of the North to five years in prison, including four years and two months suspended, enough to cover his period of pre-trial detention.

His parents, under civil liability, are ordered to pay 17,000 euros in damages.

He is therefore forced to report to the gendarmerie every year, and is registered in the judicial file of perpetrators of sexual and violent offences.

But on October 23, 2017, Julie D. sent a letter to the public prosecutor of Douai: “

I confess to having lied to you, she wrote.

Mr. Farid E. is not guilty of anything, I wish today to restore the truth.

(...) I was locked in my own lie and stuck in the grip of family secrecy.

Between her eight and twelve years, Julie D. is in fact the victim of "

repeated incest on the part of (her) big brother

", she ends up confessing, while filing a complaint for rape against her brother.

Last week, the Advocate General requested the annulment without dismissal of the conviction and the consequent deletion of the mentions in the criminal record.
