Because some climate adhesives had announced further blockades after their actions, they had to be taken into custody - eight of them are currently still behind bars.

But is that even legal?

Munich – The discussion about the climate stickers does not stop.

In several actions, they blocked streets in Munich and Bavaria.

But the police and the judiciary cracked down: eight activists were in custody until Friday, six are to be released this Saturday.

Fines were also imposed in court.

But is the detention even legal?

The state chairwoman of the left in Bavaria, Adelheid Rupp, questions this – her party is preparing a lawsuit against it.

"Sitting blockades are covered by the freedom of assembly and are not punishable in themselves," says Rupp.

Only when the limit of coercion has been crossed can one “think about penalties”.


Munich judges had also ordered the detention as a preventive measure.

Two activists have to remain behind bars until January 5th.

According to Rupp, this is “disproportionate” and “unconstitutional”.

Because here "a completed crime is not punished", but the dangerousness is evaluated with a prognosis.

The topic was discussed critically in a panel discussion on Friday in the One World House on Schwanthalerstrasse.

Defense lawyer Jochen Ringler even sees the detention as "a kind of police pre-trial detention", which should not be opposed.

"The correctional facilities are not at all willing to carry out this detention."


Jörg Jovy from the "NoPag" alliance pointed out that the Police Responsibilities Act was originally intended for use against terrorists.

So to avert danger against assassins - and not against activists.

He is now demanding "decisions by the Bavarian Constitutional Court and the Federal Constitutional Court" and warned against criminalizing activists.

Activist Lisa Pöttinger experienced this: "The state is bringing up its guns against us."


Interior Minister Herrmann lacks understanding for "climate chaos" and calls them "criminals"

Interior Minister Joachim Herrmann criticized: "The attempts by the left to curry favor with climate chaos reveal their abysmal distrust of the police."


Each individual case is examined in detail, and in the end the courts decide.

“In any case, the hurdles to long-term detention are high.

Accordingly, detention of up to 30 days will remain the absolute exception,” says Herrmann.

He finds demands for more climate protection legitimate.

"But I have no understanding whatsoever of the ruthless actions of the climate chaos."
