Justice The Constitutional paralyzes Sánchez's legal reform by six votes to five
Government Podemos pressures the PSOE to disobey the Constitutional Court
"Today the rule of law has triumphed, today our democracy has emerged strengthened."
The PP celebrates that the Constitutional Court (TC) accepted last night, in a very precautionary manner, to paralyze the parliamentary processing of the amendments presented by PSOE and United We Can to change the organic laws of the General Council of the Judiciary and the guarantee court itself.
The TC's decision shows, in the eyes of the Genoa sources consulted by this newspaper, that "there was a solid legal basis" in the PP's appeal.
"Sánchez's urgency to control the judiciary by undermining the legislature had no route," they add, and that brings about "a country model that must be changed as soon as possible."
The six magistrates of the conservative block voted in favor of estimating the very precautionary measure requested by the Popular Parliamentary Group and, consequently, stopping the processing in the
Senate
of the two partial amendments introduced in the proposal for the express modification of
the Penal Code
.
In Feijóo's team they believe that "the Government has the legitimacy to change the law, but not to do so", because there is broad doctrine against the use of amendments to change laws that have nothing to do with the ongoing process, and because the TC has already knocked down "other attempts" to do so.
And "all the powers of the State are subject to the Constitution."
For the PP, "the problem is that there is a part of the government that believes that the judges do not have legitimacy", but "the TC has not allowed itself to be influenced".
“We are getting into complicated constitutional terrain;
the ideological affiliation of the judges is not a reason to question them, and we say this on the day that the
Bárcenas
sentence has been reviewed, "they add, referring to the fact that the
National Court
archived the case yesterday on the papers of the former popular treasurer and donations in
box B
.
In Genoa they demand the PSOE to calm the waters and respect the separation of powers.
"Let's hope that the Government abides by the decision and does not continue to be involved in this drift, which has led it to describe the judges as fachas in toga," insist the popular ones.
«To say that this is a coup by the PP is indecent terminology;
It is convenient that they review that and reduce inflammation, “add the sources consulted.
"They are taking the framework of coexistence to a point of no return and that is something that is unprecedented, that is why we appeal to moderation," they insist.
“The judiciary had never been attacked with this harshness.”
Before, at noon, Alberto Núñez Feijóo had set the party's speech, in his address to the
National Board of Directors of the PP
, the highest body between congresses.
"It is unusual that the most basic pillars of our democracy have been put at risk in this way," he opined.
In his opinion, the urgent procedure that the Executive has used to modify organic laws is not only illegal, but also involves an orchestrated "attack" on the country's constitutional foundations.
"It is not Genoa or Ferraz, it is this Government or Spain," the PP leader raised the shot, in a phrase that refers to the binary dilemmas that Isabel Díaz Ayuso has been raising.
That is why Feijóo stressed that his party will continue to take the Executive's actions to court, redoubling its judicial offensive.
And not only.
"I will defend the pillars of democracy before the TC, we will once again denounce what is happening in Europe and we will go where necessary for our duty to comply with and enforce the Constitution," he settled before the barons, the Genoa staff, the mayors, deputies, senators and other senior officials of the PP.
To illustrate this intention, the PP projected, on a screen behind Feijóo, the slogan "Moderate Spain."
"The overwhelming majority of Spaniards do not share this drift," he said.
Among them, "many voters of the PSOE" and some of Podemos, as well as a portion "of moderate nationalism."
"I am not going to talk about blows, but I am going to tell Sánchez that he has lost all interest in caring for democracy," he warned.
