Biden defends the end of Title 42 before the Supreme Court, after a decision to maintain the rule in force after December 21

The president, who had until 5:00 p.m. this Tuesday to explain why the health rule should end on December 21, said that Title 42 was in the hands of the CDC and that the agency described it as unnecessary since April.


The Joe Biden Administration argued this Tuesday before the Supreme Court that it does not agree with the decision of the highest court to keep Title 42 in effect on the southern border after December 21, the date set for the end of this sanitary regulation that allows expelling migrants under the pretext of COVID-19.

Biden, who had until 5:00 p.m. to present his arguments in the case, said that the health standard should not stand because the Centers for Disease Control and Prevention

(CDC), the agency authorized to use the Title 42, determined in April that it was no longer needed.

“In April 2022, the CDC rescinded the Title 42 orders because it determined that they are no longer necessary to protect public health,” the Justice Department said in its arguments Tuesday.

A group of 19 red states had asked the Supreme Court on Monday for an "immediate" order to keep Title 42 up, amid an unprecedented arrival of asylum seekers at the southern border, which has shelters overwhelmed.

The highest court temporarily suspended the end of Title 42 after that petition to give the Biden administration more time to argue in writing why the measure should stay in effect.

Title 42 was activated by former President Donald Trump in March 2020

, and Biden maintained it after his arrival at the White House in January 2021 despite pressure from within the Democratic Party, and despite the fact that the CDC determined in April that the norm was no longer necessary to stop the coronavirus thanks to the advancement of vaccines.
