It is an important step to preserve the landscape protection in the district of Miesbach.

For this reason, the district council approved the securing of its six landscape protection areas by a majority in its most recent meeting.

Namely affected are "Schliersee and surroundings", "Tegernsee and surroundings", "Egartenlandschaft around Miesbach", "Spitzingsee and surroundings", "Oberstes Leitzachtal and its surroundings near Bayrischzell" and "Weißachtal".

Previously, the existing landscape protection area ordinances were unanimously repealed.

As reported, said regulations have become legally vulnerable.

As part of the lawsuit relating to the Saurüssellm near Bad Wiessee, the Munich Administrative Court found that the ordinances were void in cases of doubt because the original map of the landscape protection areas had been lost.

In addition, the ordinances are definitely incorrect because they contain an absolute building ban without any exemption regulations.

The standards from the 1950s are incompatible with the law in force today.

As a result, the nature conservation administration of the district office, together with the landscape protection working group set up by the district council, drew up drafts for six ordinances for temporary protection.

They are secured by resolution for two years and can be extended once for up to a further two years.

Warngau's mayor Klaus Thurnhuber (FWG) rated the security as the "right way" that the AG landscape protection had taken.

The aim is to adapt the new regulations to today's times.

In addition to the removal of built-up areas and the general building ban, current leisure behavior should also be taken into account.

Specifically, it was also decided that the municipal company Regionalentwicklung Oberland with cities and communities, lower nature conservation authorities, the Holzkirchen forestry office and affected property owners should create the conditions for a regionally balanced range of trails in the Miesbach district as a basis for a mountain bike until the final designation of a protected area -Tour offer is created.

Insofar as this is legally permissible and proportionate, cycling should also be restricted to alpine and forest paths.

Gerhard Waas (Greens) welcomed the result: "In a very short time we have achieved something that almost all of us stand behind.

We will be pioneers for others." Paul Fertl (SPD) advocated continuing the spirit of the old protection regulations: "Our natural beauties are something special and must be treated in a special way."

The three representatives of the Bavarian party could not agree.

“There is pressure to spend leisure time, but nobody thinks about the farmers,” stated Marinus Thurnhuber.

"If we interpret the laws consistently, we can save ourselves the landscape protection areas." The Bavarian party was the only party to vote against the temporary safeguards and against the new designation procedure and the determination of the personnel and funding requirements.
