The President of the Government, Pedro Sánchez, announced this Tuesday that the Government will take "as many measures as are necessary to end the blockade of the Judiciary and the Constitutional Power", after the Constitutional Court has approved the precautionary measures that the PP had requested to prevent the Senate from voting on the reform of the court itself.

Sánchez has conveyed to the citizens a message of "serenity" and "firmness" and has insisted on the need to "make the Constitution and the decision of the citizens prevail", in what he has described as a "clash of institutions so unprecedented" .

The institutional declaration of the president follows those already made last night by the highest representatives of the legislative power (Meritxell Batet, president of Congress, and Ander Gil, of the Senate).

The Constitutional Court approved last night,

thanks to the conservative majority that controls it, stop the vote scheduled for Thursday in the Senate on the reform that affects the renewal of the guarantee body itself, an unprecedented event in Spanish democracy.

This morning the Senate table met on an extraordinary basis, in which it has reaffirmed its compliance with the resolution, has eliminated the vote on the reform of the court from the agenda and has announced "an appeal" against the decision already adopted at night, by six votes to five.

The groups to the left of the PSOE are making calls this morning for a joint response to the "coup" of the Constitutional.

ERC, Bildu and Más País have expressly ruled out disobeying the court and are committed to legislative measures to move forward with the renewal of the Constitutional Court.

Meanwhile, Alberto Núñez Feijóo, promoter of the veto, also plans to appear at 1:30 p.m. today.

Meanwhile, the Judiciary holds the extraordinary plenary session to vote on the appointments of the candidates César Tolosa, Pablo Lucas and José Manuel Bandrés to magistrates for the Constitutional Court, although it is likely that none will come out because there are no majorities.

ERC rejects disobedience and advocates retaking the reform with a different procedure

ERC and Más País advocate avoiding a direct clash with the Constitutional Court and seeking another legal procedure that allows the reform to be resumed to facilitate the renewal of its members.

The formation of Íñigo Errejón already took the initiative the same Monday night and presented a bill with that objective.

The ERC spokesman in Congress, Gabriel Rufián, has also advocated for this solution after flatly ruling out the disobedience that some other leftist leaders have defended.

"Disobedience without a plan is a giant with feet of clay, it is confetti," said Rufián, who has insisted on equating the TC's decision to the legal proceedings against the Parliament of Catalonia in response to the challenge of the process.


Errejón has denounced that the guarantee court "has broken all the institutional balances of the 78 regime" and that its members "have behaved like PP deputies, who instead of defending the law obey Mr. Feijóo."

"What it is about is that the same people always govern. When they win at the polls because they win and when they don't because they hijack the institutions," denounced the leader of Más País.

El Senado cambia el orden del día y recurre al Constitucional

La Mesa del Senado ha mantenido esta mañana una reunión extraordinaria en la que se ha acordado por 4 votos a favor (3 PSOE más 1 PNV) y 3 en contra (PP) lo siguiente:


"1.    Acusar recibo, personarse y ser parte en el recurso de amparo avocado número 8263-2002, disponiendo que la representación y defensa de la Cámara sea asignada, de conformidad con el Estatuto del Personal de las Cortes Generales, a la Letrada de las Cortes Generales, doña Isabel María Abellán Matesanz, Directora de la Asesoría Jurídica de la Secretaría General del Senado, con quien se entenderán las sucesivas diligencias y trámites.

2.    Continuar la tramitación de la Proposición de Ley Orgánica de transposición de directivas europeas y otras disposiciones para la adaptación de la legislación penal al ordenamiento de la Unión Europea, y reforma de los delitos contra la integridad moral, desórdenes públicos y contrabando de armas de doble uso, con la excepción de las disposiciones transitorias cuarta y quinta y las disposiciones finales primera y segunda, apartado cuarto, cuya tramitación ha sido suspendida cautelarmente por el Tribunal Constitucional. 


3.    Comunicar el presente acuerdo al Tribunal Constitucional, a la Comisión de Justicia, a los Grupos Parlamentarios y al Congreso de los Diputados.

A las 11 de la mañana la Mesa del Senado se reunirá de nuevo, esta vez de forma ordinaria, para la modificación del orden  del Pleno conforme a lo requerido.

El Senado cambia el orden del día

A las 8.30 se ha reunido la Mesa de la Cámara Alta con carácter extraordinario para analizar el escrito del Tribunal Constitucional, estudiar las consecuencias, dar traslado a los grupos parlamentarios y adoptar las medidas pertinentes. A las 11.00, como estaba previsto antes de la decisión de anoche del tribunal, está convocada una Mesa ordinaria del Senado donde se modificaría el orden del día del pleno del jueves y se retirarían, según trasladan fuentes de la Cámara Alta, las enmiendas con las que el Gobierno pretendía modificar de forma parcial el sistema de elección de los componentes del TC. La reunión de la Mesa del Senado hoy a las 8.30, que fue convocada de manera extraordinaria pasada la medianoche aunque fuentes de la Cámara afirman que sus componentes estaba sobre aviso desde media tarde, se produce antes de la celebración de la comisión de Justicia, que está fijada para las 9.15.

El Senado se reúne para decidir cómo aplica el veto del Constitucional

Buenos días: 

El Tribunal Constitucional (TC) aprobó anoche, gracias a la mayoría conservadora que lo controla, frenar la votación prevista el jueves en el Senado sobre la reforma que afecta a su propia renovación, un hecho inédito en la democracia española. Esta misma mañana se ha reunido la mesa del Senado con carácter extraordinario para analizar las consecuencias prácticas de la decisión del organismo de garantías, aprobada por seis votos a cinco. Los magistrados que han rechazado frenar el trámite legislativo de la reforma del propio Constitucional, del sector progresista, han anunciado voto particular. El alto tribunal, tras una jornada de vértigo, aprobó casi a medianoche las medidas cautelares que había solicitado el PP para suspender la tramitación parlamentaria de la reforma, esto es, para impedir la votación en la Cámara alta, que hoy celebra pleno, como finalmente ha ocurrido. Los presidentes de ambas sedes legislativas, Meritxell Batet (Congreso) y Ander Gil (Senado) hicieron anoche sendas declaraciones institucionales, donde alertaron del peligro de deslegitimación de las instituciones, pero dejaron claro su acatamiento a la resolución. Mientras, el Poder Judicial celebra el pleno extraordinario para votar los nombramientos de los candidatos César Tolosa, Pablo Lucas y José Manuel Bandrés, a magistrados para el Tribunal Constitucional, aunque es probable que no salga ninguno porque no hay mayorías. La votación de anoche en la corte de garantías fue posible porque el bloque conservador rechazó las recusaciones de sus dos magistrados afectados por la reforma (el presidente del tribunal, Pedro González-Trevijano y el magistrado de Antonio Narváez), ambos con el mandato caducado que pueden seguir en el puesto. Enrique Santiago (PCE): "El TC vulneró la soberanía popular"

Enrique Santiago, diputado de UP y líder del PCE también ha criticado en su cuenta de Twitter lo sucedido: "El TC vulneró la soberanía popular. Una agresión a la democracia por quien debe protegerla. Procede actuar con firmeza: recurso ante los tribunales, iniciativa legislativa y llamamiento a la ciudadanía a que defienda la democracia y exija a la derecha que cumpla la Constitución".
