Too short pants in front of the café: 60-year-old convicted of exhibitionism

The shorts of a café visitor in Zorneding gave too deep a glimpse.

A 60-year-old sat several times in front of a bakery in Zorneding wearing such short pants that the employees were uncomfortable looking inside.

The case ended up in court.

– Pants that were too short and the resulting notice were the subject of negotiations at the Ebersberg district court on Tuesday.

There was a 60-year-old man sitting in the dock: last summer he had sat in front of a Zornedingen bakery smoking and drinking coffee with his penis hanging out of his pants – and according to the witnesses three or four times in a row, always on Saturdays.

At some point it was enough for the bakery saleswomen, who had to see it from the counter through the floor-to-ceiling glazing.

They reported the man.

The defendant did not deny his inadequate hosted appearances.

As a result, the only question before the court was whether it was genuine exhibitionism – or a “chain of unfortunate circumstances”, as the man’s lawyer put it.

Judge Vera Hörauf meticulously investigated the allegations.

For example, it was necessary to find out how much of the penis had looked out of the sports pants.

"Just a tip", said one of the saleswomen (43).

Actually, she and her colleague were initially amused by the supposed mishap - only when it happened several times did "I no longer feel comfortable at some point," said her colleague (37).

"Sometimes you saw more, sometimes less." Because the children of the two saleswomen were also in the store, she finally took a picture through the window and called the police.

They would not have dared to ask the man about his appearance.

The accused, married and without a criminal record, described his view of things as follows: He was blown away when four police officers arrested him one Sunday and took him for questioning.

It was only then that he realized with his short, black running shorts "that the opaque inner slip doesn't always enclose everything opaquely".

In plain language: As he sat there at the coffee table directly in front of the pane, a piece of a member became visible on his thigh.

He neither noticed anything about it nor that anyone inside the bakery could have felt disturbed.

The window glass was mirrored.

Accused apologizes - and speaks of an accident

The saleswomen contradicted this – you can see through the pane in both directions.

They would have had the impression that the unpleasant regular customer was looking for eye contact.

"I'm sure he knows what he's doing," the 37-year-old saleswoman told police.

After all, whenever he stopped by for a coffee and a cigarette, he was wearing the same precarious shorts.

The accused apologized to both women.

"I'm very uncomfortable and I'm very sorry," he emphasized several times.

He sat at the window without any bad intentions and didn't notice anything about his wardrobe problem.

"I had no qualms about wearing these trousers for short errands outside the house." He has only worn the part at home since the ad.

Also because his wife told him: "The anatomy of a 60-year-old is no longer suitable for wearing shorts like that."

Exhibitionism in Zorneding: the judge does not believe in mistakes

Judge Hörauf relieved the man of his regret about the incidents.

What she didn't believe: that they were unintentional.

"I can't imagine not feeling it," she said.

The defense attorney's argument that, according to the witnesses, the man had neither grabbed his crotch nor seen an erection during his exposure, Hörauf brushed aside: "Experience shows that exhibitionists do not have a typical type of exposure."

The judge let the defense attorney's plea for acquittal drip off.

She stayed close to the prosecutor's demand for a hefty fine.

The 60-year-old has to pay 75 daily rates of 130 euros for exhibitionist acts – makes 9750 euros.

The verdict is not yet legally binding.
