The Administrative Affairs Court in Be'er Sheva recently approved a class action lawsuit against the religious council in the city on the subject of the prohibited collection of a fee of 600 shekels from the relatives of each deceased brought to burial by her, under the section "foundation of her condition".
It is claimed that the collection is required, even though the National Insurance pays the religious council for burial fees that include basic funding for her condition.
The court's decision follows a lawsuit filed by Nekoha's daughter through attorney Neria Haroah, on behalf of approximately 4,000 relatives of the deceased who were buried in the Be'er Sheva cemetery over the course of two years.
The petitioner's attorney argued that the National Insurance Law governing this matter specifically instructs that no payment, including "service fees", shall be collected for the burial, unless the payment is permitted through regulations or law.
According to him, according to the law, the burial companies receive payment for the burial from the National Insurance Institute, therefore they are prohibited from claiming or receiving any payment in connection with the burial or the establishment of a tombstone, either directly or indirectly.
Kadisha company car,
According to the representative plaintiff, the religious council collects a mandatory payment through the builder of the foundations for the tombstones in the cemetery, taking advantage of the plight of mourners in their most difficult time.
The religious council is also required not to charge this prohibited fee in the future.
The religious council argued on the other hand that the law states that an additional payment should not be collected in connection with a burial in general, but the section does not limit the collection of a payment for a component related to its condition, and here it is a case of the tombstone builders charging a fee for the foundation of the tombstone from the deceased and thus there is nothing wrong.
