President Bashar al-Assad issued Legislative Decree No. (24) of 2022 granting a general amnesty for crimes committed before 12-21-2022.
The following is the text of the decree:
Legislative Decree No. (24)
President of the Republic
According to the provisions of the Constitution.
Draws the following:
Article 1:
A general amnesty is granted for crimes committed before 12-21-2022 in accordance with the provisions of this legislative decree.
Chapter one
Pardon the entire sentence
Article 2:
A- For the full penalty for the following crimes stipulated in the Military Penal Code promulgated by Legislative Decree No. 61 of 1950 and its amendments:
1- The crime of internal flight stipulated in Article (100).
2- The crime of external flight stipulated in Article (101).
b- The provisions of Paragraph (a) of this Article do not include those who are in hiding and those who are fleeing from justice, unless they surrender themselves within three months for internal flight and four months for external flight.
Article 3:
For the full punishment in misdemeanors and infractions.
Chapter II
Exceptions to the amnesty
Article 4:
The following are excluded from the provisions of this Legislative Decree:
A- The crimes stipulated in the following articles of the Penal Code promulgated by Legislative Decree No. (148) of 1949 and its amendments:
/271/273/275/276/277/341/347/348/349/351/361/386/387/ /398/402/403/405/428/ and /450 to /457/ and /460/ and/ 473 to 478/ and /499/500/504/507/520/576/579/580/584/625 bis/.
B- The crimes stipulated in the following articles of the Military Penal Code promulgated by Legislative Decree No. (61) of 1950 and its amendments:
Paragraphs (b-c-d) of Article (133) and Articles (134/140).
C- The crimes stipulated in Law No. (14) of 2015 and Legislative Decree No. (8) of 2021.
d- The crimes stipulated in Legislative Decree No. (40) of 2012 and its amendments.
e- The crimes stipulated in Legislative Decree No. (35) of 2015 and its amendments.
F- The crimes stipulated in Law No. (10) of 1961.
G- The crimes stipulated in Law No. (20) of 2022.
H- The crimes stipulated in Legislative Decree No. (68) of 1953.
i- The crimes stipulated in Law No. (286) of 1956.
Article 5:
The provisions of this Legislative Decree do not include:
A- Fines for violations of the laws and regulations of cutting, exchange, money transfers, traffic, tobacco, tobacco and stamps.
b- All fines stipulated in the laws that bear the nature of civil compensation.
Chapter III
General and final provisions
Article 6:
With regard to the misdemeanors stipulated in Articles (628 to 659) of the Penal Code promulgated by Legislative Decree No. /148/ of 1949 and its amendments, the following is required to benefit from the amnesty:
A- Payment by the person sentenced by a final judgment of the obligations adjudicated in favor of the plaintiff in accordance with the applicable principles, or submitting a forfeiture of a personal right.
b- If the public lawsuit has not been initiated or is in the process of trial, the amnesty shall not be availed unless there is a forfeiture of a personal right, and the aggrieved party may pay the claim advance within thirty days of the entry into force of this legislative decree, and if this period expires and the claim advance has not been paid, the provisions of this shall apply. The legislative decree, and in the event that a final judgment is issued, the convict shall benefit from the provisions of this legislative decree in the event of submitting a forfeiture of a personal right, or by paying the adjudged obligations.
Article 7:
This amnesty does not affect the personal right lawsuit, and this lawsuit remains within the jurisdiction of the court that has its hand on the common right lawsuit. This court remains the right to set up before the competent civil court.
Article 8:
This legislative decree shall be published in the Official Gazette, and shall be effective from the date of its issuance.
