“The Ruling on Genetic Imprinting on Lineage, Evidence and Negation,” is the title of the new e-book, which was prepared by two students of the third session at the Higher Institute of Judiciary, “Zainab Al-Khatib and Nermin Al-Aboud,” under the supervision of Professor Judge Ahmed Ibrahim Al-Ahmad, and it was placed in the hands of judges, lawyers, researchers, and those interested.

The book is divided into three chapters, the introductory one focused on defining the genetic imprint, which is one of the most important modern scientific discoveries, as each person has his own imprint that distinguishes him from other people, and it does not match except in the case of identical twins, in addition to focusing on its importance and areas of benefit from it.

The first topic was titled "Sharia'a Methods for Proving and Negating Paternity", through which it determined the reasons for establishing paternity, and presented the Shariah methods for proving it. It also reviews the conditions for proving paternity in both the valid contract and the corrupt contract and intercourse with the like, and the conditions for acknowledging the paternity on the same premises, and the acknowledgment of the paternity carried on others. In addition to knowing the pillars of li’an and its conditions as a legitimate way to negate lineage.

The second and last topic, titled “The Jurisprudence and Legal Judgment of Genetic Imprinting in Lineage,” clarified the conditions for working with DNA, and its role in proving lineage of unknown parentage, with an explanation of the difference between acknowledging lineage and adoption, in addition to the medical discovery in denying lineage for the various opinions of jurists in this matter with clarification. The position of the Syrian law on the genetic imprint of lineage.

Dean of the Higher Institute for the Judiciary, Judge Dr. Rawa Al-Rahbi, pointed out in the introduction to the book that the issue of DNA has sparked widespread controversy in the field of judicial work and the corridors of courts, so it occupied a very important place in the discussions of thinkers and researchers in light of positive legislation and jurisprudential opinions, stressing that it is natural to pay attention to this topic Which is closely related to the social, moral, religious and health aspects of life.

Dr. Al-Rahbi indicated that what we are witnessing today in terms of wide-ranging discoveries and developments, including scientific progress in the field of genetic engineering, is an urgent matter to delve into the depths of this method, and to address it in a detailed research that sheds light on the extent to which our current legislation is able to address the problems posed by science. , and its ability to keep pace with modern developments in order to eventually reach useful results that enrich our legal library.
