32-year-old from the district of Dachau faces long imprisonment – charges of child abuse

A 32-year-old from the western district of Dachau has to answer to the Munich district court for child abuse.

Sexual acts are said to have taken place between a 32-year-old and his 13-year-old.
The trial for the allegations of child abuse started on December 22 in the Munich district court.
The public was excluded.
Munich/Dachau – Even before the trial began on December 22,
defense attorney Joachim Schwarzenau
announced in the hallway of the Munich district court that his client, a 32-year-old man from the western district of Dachau, would admit the allegations.
Much of the process is typical of child abuse cases.
But not all.
Multiple sexual acts with the 13-year-old
It is typical that the accused, as an acquaintance of the stepfather, is associated with the two alleged victims, two boys aged 13 and 16.
It is also typical that things have escalated: at first we met to pursue common hobbies.
From the end of 2020, the younger of the two brothers often stayed with the accused with the consent of his parents.
According to the indictment, the 32-year-old performed a "custody function" for the boy.
On these occasions there were several sexual acts which the accused had performed on himself or performed on himself in the presence of the child.
He supplied drugs to 16-year-olds
In addition, the 32-year-old, who said he worked as a construction equipment operator before his arrest at the end of 2021, faces charges of illegal drug trafficking.
He has repeatedly supplied the 13-year-old's older brother with drugs, including marijuana and ecstasy.
In one case, he French-kissed the 16-year-old, who, according to the indictment, "was massively restricted in his will-formation and expression" after taking drugs.
Too private: the public is excluded
Typical of trials of this type is that the public has been excluded.
However, not only when playing the video interrogation of the two boys who are participating as joint plaintiffs.
But already when the accused is admitted.
Defense attorney Schwarzenau explained that his client wanted to comment on the matter.
He would reveal "details from the intimate area" that are not intended for the public.
After the public prosecutor's office and
lawyer Jürgen Lietz,
who represents the two boys, signaled "no objections", the criminal court granted Schwarzenau's application.
The presiding judge Martin Hofmann
justified the decision by
the accused's statements "touching the core area of personal life", behind which the public interest must take a back seat .
10,000 euros each as perpetrator-victim compensation
It is also typical for abuse trials in which the facts are clear that the accused tries to reach a compromise between the offender and the victim.
The same here: the 32-year-old paid 10,000 euros to each of the two boys in advance.
He has also announced that he will do
social therapy
.
Against this background, the parties involved "did not describe a
prison sentence of no more than four and a half years
as unrealistic," reported Judge Hofmann from a legal discussion conducted when the arrest warrant was issued.

The accused wanted a love affair with a 13-year-old
What is atypical, however, is that the defendant's crimes were apparently about more than just sexual gratification.
He told the 13-year-old several times "that he loves him and wants a relationship with him," according to the indictment.
Because of the foreseeable confession, the court has only scheduled one more hearing day early next year.
