After hearing the submissions earlier, the judge of the High Court issued a judgment today (23rd) and ruled in favor of the male policeman.
The judge overturned the jury's earlier verdict of unlawful killing and ordered the coroner to start a hearing on the incident. The judge also ordered the family of the deceased to pay the male police's legal costs.
The applicant is Police Constable Lam Wai Wing, and the respondent is Yim Shun-yee, the Coroner at the time.
The deceased, Chen Huiwang (65 years old), was a taxi driver. On November 11, 2012, he had a dispute with passengers at the WHT toll booth over fare issues.
After the police arrived at the scene, they put Chen in a uniform on the ground and handcuffed him.
When Chen was escorted into a police car, he was hooped by police officers.
A coroner's inquest opened in 2018, and a jury found Chen was unlawfully killed.
