The Movement for the Quality of Government petitioned the High Court today (Sunday) against the apparent appointment of MK Aryeh Deri as Minister, demanding the annulment of the verdict given in his case on the grounds that he had misled the court.
As I recall, in response to the petition of the Movement for the Quality of Government on the eve of the elections, the Chairman of the Elections Committee, Judge Amit, stated that in Deri's opinion there is a presumption of dishonor due to the suspended prison sentence he was sentenced to. Amit stated in his ruling that if the government component wanted to appoint Deri as a minister, he would have to contact him ( to a fellow judge) and request the removal of the presumption of libel. Apparently at the moment prime minister-designate Netanyahu has chosen not to turn to a fellow judge and instead the coalition has begun legislative procedures for a retroactive change in the basic law: the government, which states that libel will only be imposed when an actual prison sentence is imposed.

In its petition, the movement seeks to compel Netanyahu to turn to a fellow judge to determine whether Derei has defamation, and claims that the apparent appointment is "a serious violation of morality, public trust in elected officials, and the principle of governmental loyalty" and that it is tainted by lack of cleanliness and good faith, unreasonableness and extreme disproportionality.
The movement also claims that Deri misled the court, when he presented it with a false representation that he intended to retire from public life, and hence the verdict and sentence in his case are void since they were obtained by deception.
