Marijuana in First Aid Kit: Forgotten Drugs Lead to Fine

Because he had three grams of marijuana in his first-aid kit, a Forstinninger was now on trial.
He explained the drugs did not belong to him.
Forstinning - Drugs in the car without knowing it: That's what a 37-year-old Forstinninger recently told the Ebersberg district court.
He visited his family in Kosovo and lent his car to a cousin there.
At some point he noticed that he was storing marijuana in it and asked him to at least hide the drugs in the trunk.
At the end of the vacation, the cousin "forgot" three grams of marijuana in the first aid kit hiding place.
25 hours later, already in Forstinning, the accused was stopped by the police at around two o'clock in the morning.
The patrol heard about the suspect's criminal record over the radio and asked him to show him his warning triangle and first-aid kit.
The police believed him
The 37-year-old opened the trunk, whereupon the sweet smell of marijuana hit him.
"I knew where he must have hidden it and I didn't want to play dumb," Forstinninger said in court.
On site, he offered to do a urine test.
And the police searched his apartment and found nothing.
"They then believed me how it happened," he emphasized in court.
Acquittal or setting, was therefore also the demand of his defense attorney.
The prosecutor, however, had a very different opinion: "I have not the slightest doubt that he knew that he had the marijuana in the trunk," he said.
And Judge Vera Hörauf added that the man could be happy that only possession and not illegal importation was charged.
Lower penalty than in the penalty order
Her verdict was therefore also 7200 euros fine, which she based on the demand of the public prosecutor.
The penalty order had previously been set at 9,600 euros.
Because of the defendant's financial situation, the public prosecutor had demanded the lower sum.
