Y. completed her military service and did not delay.

Within a few weeks she started working as a security guard at a construction site, which had a shopping mall on the bottom floor.

Y. is happy about the role.

It wasn't easy, but at the end of the road, she realized, there was a chopper waiting for her - a preferential work grant of almost NIS 10,000.



After almost a year, Y. finished her work and applied to the National Insurance to receive the grant she was entitled to, but then she was in for a surprise - the request was unexpectedly rejected.

The reason, according to the National Insurance: it secured the mall and not the construction site itself.

In other words, she did not work in the construction industry that qualifies for a grant.



"The bottom line that emerges from this story is that every discharged soldier who wants to receive the grant should carefully check the conditions so as not to be disappointed later," says Attorney Barak Assaf, who specializes in the issue. Following a lawsuit filed by the soldier through Attorney Barak, she finally received the the grant she deserves.



"At the basic level, discharged soldiers should know that if within two years of discharge they work at a required job for at least six months, they will be entitled to a grant," explains Adv. ".



Which jobs are considered required (preferred) work and qualify for a grant?



Preferred work is recognized only in specified fields, such as agriculture, construction, industry, gas stations, hotels, and care for people with disabilities. "However, it should be noted that not every job in one of the fields qualifies in the grant, but only required areas," explains Adv. Assaf.



For example, a clerk in a hotel will not be entitled to a grant compared to a farm worker in a hotel.

The National Insurance website has a long list of required jobs that qualify for a grant for preferred work.

"You have been offered a job and you have doubts about whether the job is really required, first of all conduct an inspection on the site," he recommends.





"No, even those who have completed a period of 24 months in national service, in national-civilian service, will be entitled to a grant. In addition, girls who served in national service and stopped the service for the occasion of marriage will also be entitled to a grant, but this only if they completed at least six months of service and got married within 30 a day after its termination".

Do you have to work for six months to get the grant?



"Not necessarily. You can receive a partial grant under certain circumstances if you have worked for at least three months, for example if you have worked at a job that does not suit you or if you live a long way from work and the employer did not offer you accommodation."



Is receiving the grant automatic or do you have to do something active to receive it?



"Receiving the grant is not automatic. To receive it, one must first work in a required job for at least six months, within two years of release. The second thing the employee must do is to sign a form with the employer confirming that he has worked for at least 180 days. The employer submits this form to the National Insurance."



I applied for a preferential work grant, but it was rejected.

What should I do to exercise my rights?



"Those who submit an application for a grant and their application is rejected can appeal the decision to the Labor Court. As part of the lawsuit, that employee will be required to prove how many days he worked and where the work was done. It should be noted that the statute of limitations for filing a lawsuit in this regard is very short and stands at only one year."
