Shas' response and the prosecutor's position:
Today (Tuesday), the Shas party submitted to the High Court its position regarding the petitions in Deri's case, and requests that they be rejected.
Shas points out that the disqualification of Deri's appointment as minister is like a preference for considering the reasonableness of the opinion of the petitioners over that of about 400 thousand citizens who chose Deri to represent them.
The ombudsman, Gali Beharev-Miara, asked the High Court to postpone the response to the petitions against Deri until tomorrow.
Rabbi Miara reasoned that in the meeting with Prime Minister Binyamin Netanyahu, they discussed his consideration of appointing Deri as minister, and only after the conversation could she formulate a position, according to which she would not represent the government in the petitions.

As you may recall, the Movement for the Quality of Government petitioned the High Court against the changes in the Basic Law: The Government, which were intended to qualify the tenure of Aryeh Deri.

Judge Amit refrained from issuing an interim order to prevent the convening of the Knesset for the swearing in of the government and the appointment of Deri and issued a conditional order instructing the state to respond by January 3rd.
The President of the Supreme Court determined that the petitions against Deri will be heard by an expanded panel of 11 judges, with the hearing set for January 5, 2023 at 9:00 AM.

As a reminder, as first published in Israel Hayom, Supreme Court Judge Alex Stein ruled that the respondents, including Binyamin Netanyahu and the Knesset, must respond to the Quality of Government movement's petition against the appointment of the Shas chairman by next Wednesday.
The meaning - Aryeh Deri will be able to be appointed minister at the swearing in of the government this coming Thursday.
