Agents' right to strike: the city of Lyon dismissed by the courts

The administrative justice ruled illegal a note from the city of Lyon which reduced the right to strike of the employees of the nurseries and schools of the commune.

A decision handed down on December 30, 2022 by the Administrative Court of Lyon overturned the memorandum published on August 23, 2021 by the city of Lyon to restrict the right to strike of daycare and school workers in the municipality.

In a context of application of the law on the transformation of public life adopted in 2019 by the National Assembly, Lyon childcare workers contested the increase in working time from 1,582 to 1,607 hours or the elimination of days paid vacation.

Refusing at the time to establish a minimum service, the municipality had published its note which instituted a 48-hour provision period for any strike action, but also that any hour of strike carried out would entail the withdrawal of a day worked.

A judgment very quickly attacked by the CGT and CFDT unions who finally won their case.

We have the same behavior as that of the government at the national level with pensions, even if their political color is different.

This court decision must be a failure for a community that calls itself progressive.

to start discussions without delay with the trade unions to set up a real minimum service

Towards new strikes in nurseries and schools?

The unions are to meet Laurent Bosetti, the assistant in charge of promoting public services, next Monday.

Questioned Wednesday, Grégory Doucet, the mayor of Lyon declared that the services of the city were currently studying this court decision to find out if they were going to initiate a possible appeal.
