The act, for which a 42-year-old from the Ebersberg district was accused, was still comparatively "harmless": The exhibitionist has already been convicted of extreme sexual violence.

Now he has to go to the closed psychiatric ward.

District – The district court usually has jurisdiction in cases of exhibitionism.

The situation is different with a 42-year-old man from the southeastern Ebersberg district, who exposed himself in front of a 12-year-old girl on the S-Bahn: the Munich district court admitted him to a psychiatric ward on Wednesday.

The man has a relevant criminal record – because of a much more serious sexual offence.


With the exception of the verdict, the trial took place behind closed doors.

Even the interrogation of the accused on the first day of the trial in early December (we reported) was not public.

Defense attorney Werner Kränzlein justified this by saying that his client wanted to comment on the matter and on himself and thereby disclose "the most intimate details".


Multiple mental disorders

In the matter, the accused had confessed, reported the presiding judge Martin Hofmann in the verdict.

Accordingly, in September of the year before last, he stood in the way of the 12-year-old on the S-Bahn from Munich to Ebersberg, opened his pants and exposed his erect member in front of the girl.

Whether he also "manipulated" it, as Hofmann put it, remained open.


In addition, a forbidden butterfly knife was found in the apartment of the man who had given the job as an office clerk at the beginning of the trial.

The court sentenced the 42-year-old to one year and ten months in prison for violating the weapons law and the incident on the S-Bahn.

The judges assumed that the accused had reduced controllability in the S-Bahn.

According to Judge Hofmann, a psychiatric expert attested to him having a “multiple sexual preference disorder”.


The perpetrator is considered dangerous

Apparently, the four days of the hearing were mainly about this pathological instinctual disorder of the accused, his past life and the question of whether he should be regarded as dangerous to the public.

The 42-year-old led a "double life", Hofmann stated: He presented himself to those around him as "harmless, open and honest" and pretended an "ideal world".

In fact, however, he "betrayed" his girlfriend and "cheated" his therapist as well as his probation officer.


The therapist and probation officer should apparently support him to find his way back to a normal life.

The 42-year-old was housed in a closed place before – for ten years.

The reason was that he "made a neighbor weak and anally raped," Hofmann summarized the act at the time.


He just started taking medication

Hofmann reported that when the accused was released from the psychiatric hospital on probation, he discontinued the "instinct suppressing medication" that had been prescribed for him.

Against this background, the incident in the S-Bahn was an "act with an announcement".

The 42-year-old is not able to live out his inclinations with his girlfriend.

Rather, he is focused on "children, animals or objects".

Because the psychiatric expert put the risk of further offenses at "over 80 percent", the placement order was necessary for security reasons, the chairman added.

For a suspension of probation, the “trust basis” that the accused takes his medication reliably is missing.

In addition, the "social reception room" is missing, even if the girlfriend of the 42-year-old said that she would "not throw him out", the judge stated and added: "I am afraid" that the accused without medication would again "search for sexual objects keep a lookout".

The verdict is not yet legally binding.
