Yvelines: dismissal for police officers suspected of having hit a detainee and written a false report

The three agents had been reported in 2019 by two of their colleagues for violence against a 39-year-old man, arrested for insulting an SNCF agent.


An investigating judge dismissed three police officers suspected of having hit a man in police custody and drafted a false report at the Poissy police station (Yvelines) in January 2019, said the Versailles prosecutor's office, requested by AFP.

Unlike the prosecution, which had requested a trial for these police officers, the judge decided to close this procedure without referring the defendants to court.

The investigation concerning these three police officers from the Poissy police station (Yvelines) had been opened following a report by two of their colleagues, who had alerted their superiors to facts dating from January 15, 2019.

Contempt of an SNCF agent

That day, a 37-year-old cook was arrested at Poissy station for insulting an SNCF agent.

Placed in custody at the police station, he must be taken to hospital for a medical examination and is installed in a police car.

According to his account, he was then beaten and kicked, while his hands were handcuffed behind his back, a version disputed by the police.

The 30-year-old was prescribed the equivalent of three days of total incapacity for work (ITT).

One of the police officers, 29 years old at the time of the events, is being prosecuted for violence by a person holding public authority and another 27 years old for voluntary failure to prevent an offence.

Forgery and use of forgery

The three officials are also suspected of forgery and use of forgery for having written an incident report misrepresenting the facts.

At the same time, the cook was sentenced in immediate appearance to eight months in prison, four of which were suspended for contempt, violence and rebellion.

For their part, the police were to be tried in April 2019, but the trial was dismissed by the criminal court, which considered that an investigating magistrate should be seized.

The investigation was therefore continued, until this dismissal.

Contacted by AFP, the police lawyer, Frédéric Champagne, did not want to comment.

The plaintiff's lawyer did not respond immediately.
