Geretsrieder (66) drives a drunk moped again – seven months in prison

Within three months, a man from Geretsried was caught drunk twice and driving his moped without a license.

Seven months in prison, not parole.
That awaits a Geretsrieder who has been drunk twice within three months and without a driver's license.
Geretsried – Objection is pointless.
The man knows that from decades of court experience.
Occasionally, however, he lacks this insight, then he exerts an ultimately unsuccessful appeal process.
But this time he immediately agrees with the judge's verdict: seven months in prison, not on probation.
This is the punishment that a Geretsrieder (66) has to face because he was caught drunk and driving his moped twice within three months without a driver's license.
For the 43rd time in the dock
"You will not change in this life, the alcohol will haunt you for life," said defense attorney Christian Gerber to his client.
And that's why it's only a matter of time before the accused and the judge sit opposite each other again - as they have done 43 times.
Only the intervals between meetings in court room one seem to be getting shorter.
It was not until early summer that the 66-year-old was sentenced to five months in prison for attempted assault and insult.
Both times over two per thousand
As in the past, alcohol was the engine of all misfortunes in the current crimes.
On May 30, 2022, he steered his moped into a garden fence in Wolfratshausen with at least 2.19 per thousand alcohol in the blood.
The blood test showed 2.52 per mil three months later, when he was checked by the police in Wolfratshausen after visiting a friend at around 9 p.m.
"You can't sugarcoat it," explained attorney Gerber, who, in consultation with the accused, had waived witnesses.
The rides were undeniable.
There is currently an alcohol break again, "for two months", the accused asserted.
"And back then you were already drinking all day?" Judge Helmut Berger asked.
"Of course, when I start..." replied his long-time acquaintance.
"...then there's no holding back," Berger completed the sentence.
The accused nodded.
He also had nothing to oppose to the words of his defense attorney.
"Not driving anymore would be the right thing, not drinking anymore is hardly possible," the lawyer stated and made it clear to his client: "You will spend the next time in the prison – maybe it will help."

With the sentence of seven months, Berger followed the defense's request.
Prosecutor Thomas Mann had applied for a total sentence of one year for both offences.
In addition, a driving ban of six months and an isolated blocking period for obtaining a driver's license of one and a half years - "so that peace can come in".
The judge complied with the request of the prosecutor.
"We'll accept that immediately," said the accused and his lawyer.
