73-year-old before district court: snack man is said to have molested 14-year-olds

A man from the district of Starnberg has to answer before the Dachau district court.

He is accused of sexually abusing a child.

When does a compliment become sexual harassment?

What kind of approach can a child be expected to take?

And how long are you actually a child?

Questions like these were heard yesterday at the district court.

In the dock: a 73-year-old snack vendor with multiple convictions.

Dachau

– When you sit across from Hubert M. (name changed, editor) you think he is a friendly, older gentleman.

Neat suit, neatly shaved beard, neat hairdo.

In fact, however, the 73-year-old M. has been a criminal since he was 17 years old.

In 1966 he ended up in court for the first time, in 1971 he went to prison for the first time.

The list of criminal offenses is as long as it is wide: theft, fraud, driving without a license, negligent drunk driving, intentional drunk driving, aggravated extortion robbery, forgery of documents, vandalism and prisoner mutiny.

Explicitly not included so far: sexual offenses.

But such a thing could now be added if the Munich public prosecutor's office has its way.

She accuses Gilchinger of sexual abuse of children.

On April 30, 2021, around 3:30 p.m., the 73-year-old is said to have first spoken to a 14-year-old schoolgirl from his food truck in the city of Dachau and then – after he left his car – touched him inappropriately.

According to the indictment, by telling her that he wanted to marry her by putting his hand on her shoulder, then on her waist and finally even on her bottom, he "performed sexual acts on a child".

The defendant “approved” that the 14-year-old was “recognizable” not a teenager.

Hubert M. did not want to comment on the case before the district court yesterday.

Through his lawyer Florian Zeugner, however, he explained that he "comprehensively" rejected the allegations.

"Possibly" he complimented the girl or touched her "harmlessly".

But it is "excluded" that this happened against the background of sexual motivation!

If the 14-year-old felt "uncomfortable" because of this, he is sorry.

Girl bursts into tears several times during testimony

On the witness stand, the 15-year-old emphasized that she felt more than "uncomfortable".

Judge Cornelia Handl made the girl cry for the first time when she explained that false testimonies would be punished "harshly" in court.

In the course of the further questioning, the student also repeatedly shed tears.

For example, when she explained that she didn't know what to do at the moment when the accused pressed her buttock with his hand: "I didn't understand that.

I didn't know how to deal with something like that.

Was that maybe just meant to be funny?” But didn't she react at all when the hand was on her bottom, Handl wanted to know?

"No, I didn't do anything," said the girl.

In any case, she has not passed by the place where the 73-year-old's food truck was parked.

The fact that the matter finally became known to the police was due to the student telling her brother about it, who then informed the parents.

She also told a friend about the incident.

The girlfriend who walked past the food truck next to her on April 30, 2021, noticed what happened just as much as she did, the girl reported: “I wanted to know if she saw it too.

Because I didn't know if it was just in my head."

Hearing resumes on January 30th

But this is exactly what the defender of the 73-year-old assumes.

He persuaded Judge Handl to hear exactly this friend and, in his eyes, an important witness to the incident in court.

Because, the lawyer insinuated, maybe the then 14-year-old "maybe just persuaded herself" that she "felt" something on her butt?

This question will now be resolved on January 30th when the hearing continues with the girlfriend's testimony.

It is unlikely that the student concerned will hear this in court.

The process was very upsetting for her, she explained through tears.

Judge Handl also attested to her making a "very touched impression".
