Oise: in conflict with his neighbour, he bombards his house 106 times with eggs and paintball balls

For a dark story of parking, this 52-year-old RATP controller harassed his neighbor, in La Chapelle-en-Serval, at the trigger point

A banal neighborhood dispute that degenerates and we can end up before the criminal court of Senlis.

With the side of the victim, a resident of La Chapelle-en-Serval, exhausted after fifteen months of harassment from her neighbor, translated by 106 acts of degradation, 60 complaints, and a very poor state of health which will repeatedly raise fears of discomfort during the hearing on Monday afternoon.

On the other side, the defendant, Franck J., a 52-year-old colossus who tries to put on a good face, speaks in a very chaste French, but which badly conceals a certain arrogance which will quickly irritate the magistrates.

Since July 2021, the victim's property, located rue de la mairie, in La Chapelle-en-Serval, has very regularly been the target of projectiles of all kinds: eggs most often, stones, but also paintballs used by paintball enthusiasts.

The incredible repetition of these throwing objects on the facade or the roof of the house, or the victim's car, led the gendarmes of the Orry-la-Ville brigade to conduct a neighborhood investigation in which Franck J. does not bother to hide her animosity towards her neighbor across the street.

"We can throw dead calves at him, I don't care"

“We can throw dead calves at him, I don't care!

” declares Franck J. to the soldiers, who consider that the one who is ready to throw an ox is undoubtedly capable of throwing an egg.

A camera is installed in the victim's home, without conclusive results.

The gendarmes organize hideouts in the street on several occasions to unmask the egg thrower responsible for the state of health of the victim, now on antidepressants.

And on the night of October 25 to 26, a Psig patrol (gendarmerie surveillance and intervention platoon) saw Franck J. throw something in the direction of the house.

Caught red-handed, the 50-year-old persists in denying any responsibility before recognizing jets of paintballs, five or six times.

"But I don't want my wife involved in this, or I'm going to hug the other bitch!"

“Frank J. again indicates to the investigators.

At the hearing, he tries to give a better impression but hardly succeeds, minimizing his behavior.

“I am not responsible for all the facts, I threw paintballs, never eggs,” he asserts confidently.

Beyond the statistical sciences, which make the presence of two projectile launchers in the same place unlikely, the gendarmes' investigation has brought to light other incriminating elements.

According to the analysis of his telephone, Franck J. is present at his home whenever damage is committed.

And his substantial purchases of eggs in the nearby supermarket surprised one of the cashiers who testified to the gendarmes.

“We are five at home, that does not represent an abnormal consumption of eggs”, objects Franck.

“Fingerprints on eggshells”

“There has never been any other suspect apart from him, remarks Me Mathieu Marlot, lawyer for the victim.

He must have taken great pleasure in seeing her regularly clean his roof or facade.

“” Everything is excessive in this file, sighs the deputy prosecutor, Hugo Sellier.

It is a neighborhood report that has slipped but we have the impression of seeing the behavior of a teenager when the defendant is 52 years old and works as a controller at the RATP.

For the defense of Franck J., it is the deployment of means in this investigation which seems disproportionate.

“We went so far as to look for fingerprints on eggshells, is surprised Me Imed-Eddine Abderhim.

I ask that he be released for moral harassment, because he only admitted a few facts, over a very short period of time.

»

The court nevertheless found him guilty on all of the charges and sentenced him to six months in prison with probation.

He is prohibited from coming into contact with the victim or appearing at his home.

He is also prohibited from possessing or carrying a weapon and will have to pay damages to the victim, which will be determined later.
