- "The construction work stopped immediately," reported Mayor Norbert Riepl (CSU/DG) at the most recent meeting of the municipal council.

The "unexpected" happened.

"I was and still am horrified at how little preventive measures and conditions are recognized by the judiciary and how few goals and financial consequences are taken into account here."

As is well known, the municipality is planning to build a day café including sanitary facilities and two multi-purpose rooms in the former stables on the monastery grounds in Spielberg.

Brucker Forum and adult education center could hold courses there.

The project has long since received a two-million-euro grant from the government.

In October 2020, the municipal council approved the project, and the district office then also approved the whole thing.

Architect Anette Primpke had planned to start construction in May 2022 and finish in March 2023.

But everything was to be different.

A lawsuit was filed with the Bavarian Administrative Court in March.

A neighbor of the stables sued against the building permit, i.e. against the district authority that had granted the permit.

It took a while for the plaintiff to submit a statement of reasons, only then could the district office submit a statement of defense.

The neighbor fears increased noise pollution.

However, the district authority disagreed.

The internal specialist department for immission control was also consulted.

The conclusion of the district office: one does not share the concerns of the residents, compliance with the relevant noise protection guidelines should be ensured, for which conditions were set.

In October last year, the plaintiff then submitted an urgent application to the court: An urgent application is usually intended to bring about a quick decision by the court.

In this case, it was about stopping the ongoing renovation work until a verdict was reached on the main issue.

That is exactly what has happened.

Mayor Riepl emphasized with regard to the decision regarding the urgent application: "It hit me massively and is still hitting me.

Exaggerated worries and requests are becoming more and more important. "Because: "We don't have anything crazy planned." Such a "blockade" is very annoying.

The panel then debated the matter further in a non-public session.

Riepl did not want to comment on the content of the discussion, referring to a pending case.

The final decision on how to proceed with the day café is only made in the main hearing.
